Regarding this issue, LawNet would like to answer as follows:

On June 29, 2023, the Government of Vietnam issued Decree 42/2023/ND-CP regulating pensions, social insurance allowances, and monthly allowances.

1. Who is eligible to have their pension, social insurance allowance, and monthly allowance adjusted from July 1, 2023 in Vietnam?

Specifically, in Clause 1, Article 1 of Decree 42/2023/ND-CP, the adjustment of pension, social insurance allowance, and monthly allowance for beneficiaries of pension, social insurance allowance, and monthly allowance before 1/7/2023 will apply to the following 09 subjects:

(1) Cadres, civil servants, workers, officials, and employees (including people who have time to participate in voluntary social insurance, retirees from Nghe An agricultural social insurance fund was transferred under Decision 41/2009/QD-TTg); military personnel, people's police, and people doing cipher work are receiving monthly pensions.

(2) Officials of communes, wards, and townships specified in Decree 92/2009/ND-CP; Decree 34/2019/ND-CP amending and supplementing a number of regulations on commune-level cadres, civil servants, and part-time workers at the commune level, in villages and residential quarters; Decree 121/2003/ND-CP; and Decree 09/1998/ND-CP amending and supplementing Decree 50/CP dated 26/7/1995 on the living expenses regime for commune, ward, and township officials who are receiving monthly pensions and allowances.

(3) Persons who are receiving monthly allowance for loss of working capacity as prescribed by law; people who are receiving monthly allowance under Decision 91/2000/QD-TTg, Decision 613/QD-TTg; rubber workers are enjoying monthly allowance according to Decision 206-CP dated 30/5/1979.

(4) Officials of communes, wards, and townships who are receiving monthly allowances according to Decision 130-CP dated June 20, 1975, supplementing policies and remuneration regimes for commune officials and employees, and Decision 111-HDBT dated October 13, 1981, amending and supplementing a number of policies and regimes for commune and ward officials.

(5) Military personnel are enjoying the monthly allowance according to Decision 142/2008/QD-TTg (amended by Decision 38/2010/QD-TTg dated May 6, 2010).

(6) People's Public Security is receiving a monthly allowance under Decision 53/2010/QD-TTg.

(7) Soldiers, people's police, and people doing cipher work receive salaries like soldiers and people's police who are receiving monthly allowances according to Decision 62/2011/QD-TTg.

(8) Persons who are receiving monthly labor accident and occupational disease allowance.

(9) Persons receiving monthly survivorship allowance before January 1, 1995.

In addition, the subjects specified in (1), (2), (3), (4), (5), (6), and (7) are retired to enjoy pensions, social insurance benefits, and social security benefits. Before January 1, 1995, after making adjustments as prescribed in Clause 1, Article 2 of Decree 42/2023/ND-CP, the pension, social insurance allowance, and monthly allowance were under VND 3,000,000/month.

2. Adjustment level of pension, social insurance allowance, and monthly allowance in Vietnam

Specifically, in Article 2 of Decree 42/2023/ND-CP, stipulating the adjustment levels of pensions, social insurance allowances, and monthly allowances applicable to the subjects in Section 1, as follows:

- From July 1, 2023, adjustments will be made as follows:

+ An increase of 12.5% on the pension, social insurance allowance, and monthly allowance of June 2023 for the subjects specified in item 1 has been adjusted according to Decree 108/2021/ND-CP dated December 7, 2021 of the Government regulating pensions, social insurance allowances, and monthly allowances.

+ An increase of 20.8% on the pension, social insurance allowance, and monthly allowance of June 2023 for the subjects specified in item 1, which has not been adjusted according to Decree 108/2021/ND-CP dated December 7, 2021 of the Government regulating pensions, social insurance allowances, and monthly allowances.

- From July 1, 2023, people who are enjoying pensions, social insurance allowances, and monthly allowances as prescribed in Section 1, after adjusting according to the above provisions, if the benefit level is lower than VND 3,000,000/month, the adjustment will be increased as follows:

An increase of 300,000 VND/person/month for those who receive less than 2,700,000 VND/person/month; an increase to 3,000,000 VND/person/month for those who enjoy from 2,700,000 VND/person/month to less than 3,000,000 VND/person/month.

More details can be found in Decree 42/2023/ND-CP, effective as of August 14, 2023. The provisions of Decree 42/2023/ND-CP will be implemented from July 1, 2023.
