Recently, the Government of Vietnam has issued the Decree No. 98/2020/NĐ-CP prescribing penalties for administrative violations against regulations on commerce, production and trade in counterfeit and prohibited goods, and protection of consumer rights.
According to Article 7 of the Decree No. 98/2020/NĐ-CP of Vietnam’s Government, penalties for provision of services included in the list of banned business lines are as follows:
- A fine ranging from VND 60.000.000 to VND 80.000.000 shall be imposed for providing services included in the list of banned business lines.
- Additional penalty: The exhibits and instrumentalities used for committing the violation shall be confiscated.
- Remedial measure: The violating entity is compelled to return any benefits illegally obtained from the commission of the violation.
Currently, 07 banned business lines are specified in Article 6 of the Law on Investment 2014 of Vietnam, including:
- Trade in the narcotic substances;
- Trade in the chemicals and minerals;
- Trade in specimens of wild flora and fauna;
- Prostitution;
- Human trafficking; trade in human tissues and body parts;
- Business pertaining to human cloning;
- Trade in firecrackers.
Thus, a fine ranging from VND 60.000.000 to VND 80.000.000 shall be imposed for providing services included in the list of banned business lines mentioned above. Concurrently, the violating entity is also subject to additional penalty and remedial measure as prescribed by law.
