Recently, the Government of Vietnam has issued the Decree No. 98/2020/NĐ-CP prescribing penalties for administrative violations against regulations on commerce, production and trade in counterfeit and prohibited goods, and protection of consumer rights.
According to Article 26 of Decree No. 98/2020/NĐ-CP of Vietnam’s Government, administrative penalties for violations against regulations on import of spirits are as follows:
- A fine ranging from VND 20.000.000 to VND 30.000.000 shall be imposed for committing one of the following violations:
+ Directly importing or entrusting the import of semi-finished spirits for production of finished spirits having at least 5.5% ABV without obtaining a license for trade in alcoholic beverages;
+ Selling imported semi-finished spirits having at least 5.5% ABV to an entity that does not hold a license for mass production of spirits.
- Additional penalty: The license for trade in alcoholic beverages shall be suspended for a fixed period of 01 – 03 months if the above-mentioned violation is repeated or re-committed.
- Remedial measure: The violating entity is compelled to return any benefits illegally obtained from the commission of the violation of “Selling imported semi-finished spirits having at least 5.5% ABV to an entity that does not hold a license for mass production of spirits”.
Acts of importing spirits not through international border checkpoints shall be penalized in the form of fines, additional penalties, forced implementation of remedial measures as above.
