Vietnam: How is the fine for selling tobacco products to persons under 18?

This is an important content of the Decree No. 98/2020/NĐ-CP of Vietnam’s Government prescribing penalties for administrative violations against regulations on commerce, production and trade in counterfeit and prohibited goods, and protection of consumer rights, issued on August 26, 2020.

According to Article 23 of Decree No. 98/2020/NĐ-CP of Vietnam’s Government, fines for violations against regulations on sale of tobacco products are as follows:

- A fine ranging from VND 500.000 to VND 1.000.000 shall be imposed for failing to display the notice stating “It is illegal to sell tobacco products to anyone under the age of 18” at the point of sale as prescribed.

- A fine ranging from VND 1.000.000 to VND 2.000.000 shall be imposed for committing one of the following violations:

+ Selling tobacco products to persons under 18;

+ Employing persons under 18 to sell tobacco products.

- A fine ranging from VND 2.000.000 to VND 3.000.000 shall be imposed for failing to comply with regulations on display of tobacco products at the point of sale.

- A fine ranging from VND 3.000.000 to VND 5.000.000 shall be imposed for committing one of the following violations:

+ Failing to report or submitting false reports on business status/income and distribution system of a tobacco retailer;

+ Selling tobacco by using an automatic vending machine or at the premises where the sale of tobacco is prohibited;

+ Selling tobacco within a radius of 100 m from the outer boundary of a kindergarten, nursery school, primary school, lower or upper secondary school, medical research institute, hospital, maternity ward, preventive medical center or medical station of a commune or ward.

- A fine ranging from VND 5.000.000 to VND 10.000.000 shall be imposed for failing to report or submitting false reports on business status/income and distribution system of a tobacco distributor or tobacco wholesaler.

The violating entity shall be applied with additional penalties as follows:

- The exhibits and instrumentalities of the violation shall be confiscated;

- The license for trade in tobacco products shall be suspended for a fixed period of 01 - 03 months if the violation is committed.

Thus, selling tobacco products to persons under 18 or employing persons under 18 to sell tobacco products shall be fined from VND 1.000.000 to VND 2.000.000.
