Vietnam: How are fines for violations against regulations on stamping of imported tobacco products?

According to Article 20 of Decree No. 98/2020/NĐ-CP of Vietnam’s Government, fines for violations against regulations on stamping of imported tobacco products are as follows:

- A fine ranging from VND 2.000.000 to VND 5.000.000 shall be imposed for the violation involving goods worth less than VND 10.000.000;

- A fine ranging from VND 5.000.000 to VND 10.000.000 shall be imposed for the violation involving goods worth from VND 10.000.000 to under VND 20.000.000;

- A fine ranging from VND 10.000.000 to VND 15.000.000 shall be imposed for the violation involving goods worth from VND 20.000.000 to under VND 30.000.000;

- A fine ranging from VND 15.000.000 to VND 20.000.000 shall be imposed for the violation involving goods worth from VND 30.000.000 to under VND 40.000.000;

- A fine ranging from VND 20.000.000 to VND 25.000.000 shall be imposed for the violation involving goods worth from VND 40.000.000 to under VND 50.000.000;

- A fine ranging from VND 25.000.000 to VND 30.000.000 shall be imposed for the violation involving goods worth from VND 50.000.000 to under VND 60.000.000;

- A fine ranging from VND 30.000.000 to VND 35.000.000 shall be imposed for the violation involving goods worth from VND 60.000.000 to under VND 70.000.000;

- A fine ranging from VND 35.000.000 to VND 40.000.000 shall be imposed for the violation involving goods worth from VND 70.000.000 to under VND 80.000.000;

- A fine ranging from VND 40.000.000 to VND 50.000.000 shall be imposed for the violation involving goods worth from VND 80.000.000 to under VND 100.000.000;

- A fine ranging from VND 50.000.000 to VND 70.000.000 shall be imposed for the violation involving goods worth VND 100.000.000 or more.

Concurrently applying additional penalties:

- The exhibits of the administrative violations shall be confiscated;

- The license for trade in tobacco products shall be suspended for a fixed period of 03 - 06 months if the violation is repeated or re-committed.

Thus, penalties for violations against regulations on stamping of imported tobacco products shall be up to VND 70.000.000, the exhibits of the administrative violations shall be confiscated; or he license for trade in tobacco products shall be suspended for a fixed period of 03 - 06 months if the violation is repeated or re-committed.
