Vietnam: Guiding the contents of the application for establishment of the judicial expertise Office

Recently, the Government of Vietnam has issued Decree No. 85/2013/NĐ-CP stipulating in detail and measures to implement the Law on Judicial Expertise of Vietnam.

According to Decree No. 85/2013/NĐ-CP of Vietnam’s Government, application for establishment of the judicial expertise Office must have the main contents as follows:

- Full name, date of birth, place of permanent residence registration, identity card number of the person asking for the establishment of the Office;

- Full name of partners and capital contributors;

- Name and expected address of the Office;

- Area of judicial expertise;

- Commitment to compliance with law in the course of operation.

Besides, the Draft Regulation on organization and operation of the judicial expertise Office operating in the form of private enterprise must have the following main contents:

- Name and expected of the Office;

- Area of judicial expertise;

- Full name, date of birth, place of permanent residence registration, identity card number of the legal representative of the Office;

- List of judicial experts working under the contract (if any);

- Regulations on the employment of judicial experts;

- Rights and obligations of the Office;

- Regulations on information and report;

- Effect.
