Vietnam: Department of Personnel and Organization shall review the team of legal experts of the bank

Specifically, according to Article 25 of the Circular No. 14/2020/TT-NHNN of the State Bank of Vietnam, responsibilities of the Department of Personnel and Organization in judicial expertise activities in the monetary and banking sectors are as follows:

- Carrying out responsibilities related to advising and submitting to the Governor of the State Bank on appointment, card issuance, dismissal and revocation of judicial assessor cards; recognizing, canceling recognition, posting the list of judicial expertise according to the case and change information about judicial expertise according to the case; establishing the assessment council specified in this Circular.

- To assume the prime responsibility for, and coordinate with the Banking Inspection and Supervision Agency and other units in, reviewing and strengthening the contingent of judicial expertisers in the monetary and banking sectors.

Particularly for the Banking Officer Training School, assume the prime responsibility for, and coordinate with the Personnel and Organization Department, the Banking Inspection and Supervision Agency and other units under the State Bank in training and retraining in expertise and legal knowledge for the team of judicial experts in the monetary and banking sectors.

In addition, Article 26 of this Circular also stipulates the responsibilities of judicial experts and case-based judicial experts in the monetary and banking sectors as follows:

- Strictly follow the judicial expertise process; deliver, receive, unseal dossiers, expertised objects, information, documents, objects and samples; preparation for inspection; carry out judicial expertise; additional assessment, first re-examination; assessment conclusions; prepare and hand over the assessment dossier specified in this Circular.

- Fully and properly perform the responsibilities and obligations specified in Clauses 1, 2 and 3 Article 11; Clause 2, Clause 3 Article 23; Clauses 2 and 3, Article 28 of the Law on Judicial Expertise of Vietnam.

- Participate in training courses on expertise and legal knowledge.

- Report to the head of the unit directly managing them on the progress and results of the assessment to implement the reporting regime specified in Article 23 of this Circular.
