Article 18 of the Lawyer Law 2006 stipulates the revocation of Lawyer Practice Certificates for individuals who have been granted the Practice Certificate but are recruited, appointed as officials and public employees.
Regulations on the revocation of law practice certificates still apply to the following subjects:
(1) Officers, professional soldiers, and defense employees in agencies and units of the People's Army; commissioned and non-commissioned officers in professional and technical positions in agencies and units of the People's Police;
(2) No longer residing permanently in Vietnam;
(3) No longer meeting the qualifications of a lawyer;
(4) Subject to disciplinary action in the form of removal from the list of lawyers of a Bar Association;
(5) Stripped of the right to use the law practice certificate;
(6) Convicted and the judgment has legal effect.
The Minister of Justice has the authority to revoke the law practice certificates for the above-mentioned subjects within 15 days from the date of receipt of the proposal document for the revocation of the law practice certificate.
For those subject to disciplinary action in the form of removal from the list of lawyers of a Bar Association, within 07 working days from the date of the disciplinary decision, the Management Board of the Bar Association that disciplined the lawyer shall send a proposal document to the Minister of Justice to revoke the law practice certificate. The person whose law practice certificate is revoked must cease practicing law from the date of the disciplinary decision to remove their name from the list of lawyers of the Bar Association.
When discovering that a lawyer falls into one of the cases subject to revocation of the law practice certificate (1), (2), (3), (4), and (6), the Bar Association of which the lawyer is a member or other agencies and organizations shall send a proposal document to the Minister of Justice to revoke the law practice certificate of that lawyer.
