On September 06, 2024, the Minister of Industry and Trade issued Decision 2389/QD-BCT on the Regulation on making of statements and provision of information by the Ministry of Industry and Trade to the Press in Vietnam

1. Regulation on the spokesperson and provision of information by the Ministry of Industry and Trade to the Press in Vietnam

According to Article 3 of the Regulation issued together with Decision 2389/QD-BCT in 2024 on spokesperson and provision of information by the Ministry of Industry and Trade to the Press in Vietnam

- The Minister of Industry and Trade;

- The person assigned by the Minister to regularly speak and provide information to the press (hereinafter referred to as the Spokesperson).

The name, position, phone number, and email address of the Spokesperson of the Ministry of Industry and Trade are announced in writing to the press agencies, state management agencies on press, and posted on the Ministry's electronic portal;

- Authorized spokespersons include: Deputy Ministers of Industry and Trade; Leaders of units under the Ministry of Industry and Trade or individuals assigned by the Minister to provide information to the press on specific issues assigned (hereinafter referred to as Authorized Spokesperson).

The authorized leaders in the absence of the Minister at the office, Spokesperson, Authorized Spokespersons prescribed in points b and c, clause 1, Article 3 of the Regulation issued together with Decision 2389/QD-BCT in 2024 are responsible to the Minister for the content of the statements and providing information to the press.

Individuals of the Ministry of Industry and Trade not specified in points a, b, c, clause 1, Article 3 of the Regulation issued together with Decision 2389/QD-BCT in 2024 are allowed to provide information to the press according to legal regulations, but are not allowed to represent the Ministry of Industry and Trade in making statements, provide information to the press, and are legally responsible for the content of the information they provided.

The Spokesperson, Authorized Spokesperson specified in points b and c, clause 1, Article 3 of the Regulation issued together with Decision 2389/QD-BCT in 2024 are not allowed to further delegate the authorization to others.

The Spokesperson and Authorized Spokespersons specified in points b and c, clause 1, Article 3 of the Regulation issued together with Decision 2389/QD-BCT in 2024 if unable to speak and provide information to the press, must report to the Minister to authorize another responsible person to carry out the statements and provide information to the press.

2. Responsibilities of the Minister of Industry and Trade in making statements and providing information to the Press in Vietnam

Responsibilities of the Minister of Industry and Trade in making statements and providing information to the Press in Vietnam are prescribed in Article 9 of the Regulation issued together with Decision 2389/QD-BCT in 2024 as follows:

- The Minister of Industry and Trade directly makes statements or assigns the task to the Spokesperson or authorizes another Deputy Minister, Leaders of units, or individuals under the Ministry to make statements and provide information to the press according to Article 2 of the Regulation issued together with Decision 2389/QD-BCT in 2024.

- The Minister of Industry and Trade has the right to make statements and provide information to the press even in cases where the task has been assigned or authorization has been given to others to make statements and provide information to the press.

- The Minister of Industry and Trade organizes and directs the preparation of information and speaking policies of the Ministry of Industry and Trade.
