Press Release No. 20 on the 4th Session of 15th National Assembly of Vietnam

Monday, November 14, 2022, the 4th Session of the 15th National Assembly of Vietnam entered its 20th working day at the National Assembly House, Hanoi.

Morning

Content 1: Under the chairmanship of Deputy Chairman Nguyen Khac Dinh, the National Assembly of Vietnam heard the Chairman of the Legal Committee of the National Assembly, Hoang Thanh Tung, present the Report on Explanation, Acceptance, and Revision of the Draft Law on Inspection (amended). Subsequently, the National Assembly voted to pass Article 18, Article 78, and the entire Law on Inspection (amended), with the following results:

- Regarding Article 18 on Position and Function of Inspection Departments and Divisions: 470 delegates participated in the vote (94.38% of the total NA delegates), with 445 delegates in favor (89.36% of the total NA delegates); 16 delegates not in favor (3.21% of the total NA delegates); and 09 delegates abstaining (1.81% of the total NA delegates).

- Regarding Article 78 on Issuing Inspection Conclusions: 467 delegates participated in the vote (93.78% of the total NA delegates), with 444 delegates in favor (89.16% of the total NA delegates); 08 delegates not in favor (1.61% of the total NA delegates); and 15 delegates abstaining (3.01% of the total NA delegates).

- Regarding the entire Law on Inspection (amended): 471 delegates participated in the vote (94.58% of the total NA delegates), with 459 delegates in favor (92.17% of the total NA delegates); 10 delegates not in favor (2.01% of the total NA delegates); and 02 delegates abstaining (0.40% of the total NA delegates).

Content 2: Under the chairmanship of Deputy Chairman Nguyen Duc Hai, the National Assembly heard the Chairman of the Economic Committee of the National Assembly, Vu Hong Thanh, present the Report on Explanation, Acceptance, and Revision of the Draft Law on Petroleum (amended). Subsequently, the National Assembly voted to pass the Law on Petroleum (amended), with the following results: 475 delegates participated in the vote (95.38% of the total NA delegates), with 472 delegates in favor (94.78% of the total NA delegates); and 03 delegates not in favor (0.60% of the total NA delegates).

Content 3: Under the chairmanship of Deputy Chairman Nguyen Duc Hai, the National Assembly discussed in the Hall the Draft Law on Land (amended).

In this session, 22 delegates spoke, and 04 delegates debated. Most delegates agreed on the necessity to amend the Land Law to institutionalize Resolution No. 18-NQ/TW, to perfect the legal corridor on land in accordance with the socialist-oriented market economy in the context of international integration, and to resolve the overlaps, obstructions, and inadequacies in recent times. In addition, delegates focused on discussing the following issues: the dossier, structure of the Draft Law; the consistency of the Draft Law with the current legal system; land pricing; homestead land, land for production for ethnic minorities in mountainous regions; expanding the land allocation limit for households and individuals; land pricing framework; land registration, property rights attached to land; citizens' rights and obligations related to land; gathering public opinions on land use planning and plans; principles of land compensation when the State recovers land; expanding the subject and limit of agricultural land use rights transfer; conditions for executing the rights to convert, transfer, lease, lease back, inherit, donate, mortgage land use rights; capital contribution using land use rights; the State's land recovery for defense, security, national interest, public interest; rights of organizations and individuals when the State recovers land; cases of State land recovery; authority to recover land; conditions for land allocation, land lease; resettlement issues, compensation pricing when the State recovers land; authority to resolve land disputes; legal and practical basis for land pricing; land valuation capacity, establishment of an independent land pricing agency; adding commercial mediation into the dispute resolution mechanism; management and use of land under agricultural, forestry companies' management; operations of land registration office; land recovery projects to create land reserves; using land by receiving land use rights transfer, lease, capital contribution for investment projects; regulations on land limits; administrative procedures on land; benefit-sharing mechanisms between enterprises and community...

Afternoon

Content 1: Under the chairmanship of Deputy Chairman Nguyen Duc Hai, the National Assembly continued discussing in the Hall the Draft Law on Land (amended). In this session, 16 delegates spoke, and 03 delegates debated, focusing on the following issues: Land Pricing Appraisal Council; mechanisms, principles, methods, consulting land pricing determination; the role of elected bodies in supervising land pricing determination; agricultural land concentration; multi-purpose land use; preferential land policy to build education and training institutions; policies for the use of various types of land; conditions for land allocation, land lease, change of land use purpose; mechanisms and policies to support and compensate when the State recovers land; basis and timing of land levy calculation and land rent; agricultural land bank; removing the land price framework; auction of land use rights for uncompensated, supported, resettled land; land with historical-cultural relics, scenic spots, natural heritage; conditions for the State to decide on land allocation, land lease without auctioning land use rights and not bidding projects using land; rights and obligations of households and individuals using land; conditions for land compensation when the state recovers land for defense, security purposes; economic-social development for national, public benefits; consistency between Land Law provisions and relevant laws; implementation provisions...

After the discussion session, Minister of Natural Resources and Environment Tran Hong Ha provided explanations and clarified some issues raised by the National Assembly delegates.

Content 2: Under the chairmanship of Standing Deputy Chairman Tran Thanh Man, the National Assembly heard the Chairwoman of the Social Affairs Committee of the National Assembly, Nguyen Thuy Anh, present the Report on Explanation, Acceptance, and Revision of the Draft Law on Prevention and Combat of Domestic Violence (amended). Subsequently, the National Assembly voted to pass Article 3, Article 32, Article 33, and the entire Law on Prevention and Combat of Domestic Violence (amended), with the following results:

- Regarding Article 3 on Domestic Violence Acts: 481 delegates participated in the vote (96.59% of the total NA delegates), with 470 delegates in favor (94.38% of the total NA delegates); and 11 delegates abstaining (2.21% of the total NA delegates).

- Regarding Article 32 on Comments and Criticism within the Community for People Committing Domestic Violence Acts: 479 delegates participated in the vote (96.18% of the total NA delegates), with 446 delegates in favor (89.56% of the total NA delegates); 18 delegates not in favor (3.16% of the total NA delegates); and 15 delegates abstaining (3.01% of the total NA delegates).

- Regarding Article 33 on Community Service Work: 474 delegates participated in the vote (95.18% of the total NA delegates), with 465 delegates in favor (93.37% of the total NA delegates); 05 delegates not in favor (1.00% of the total NA delegates); and 04 delegates abstaining (0.80% of the total NA delegates).

- Regarding the entire Law on Prevention and Combat of Domestic Violence (amended): 474 delegates participated in the vote (95.18% of the total NA delegates), with 465 delegates in favor (93.37% of the total NA delegates); 05 delegates not in favor (1.00% of the total NA delegates); and 04 delegates abstaining (0.80% of the total NA delegates).

Tuesday, November 15, 2022:Morning, the National Assembly will vote to pass: the Resolution on issuing the amended National Assembly session rules; the Resolution on piloting certain specific mechanisms and policies for the development of Buon Ma Thuot city, Dak Lak province. The National Assembly will then discuss in the Hall the Draft Law on Petroleum (amended); Afternoon, the National Assembly will vote to pass: the amended Law on Anti-Money Laundering; the Resolution on piloting the granting of the right to choose and use auto license plates through auctions; the Resolution on the results of thematic supervision “The implementation of policies and laws on thrift practices and anti-wastefulness in the 2016-2021 period.” After that, the National Assembly of Vietnam will hold the closing session, voting to pass: the Resolution on questioning and answering questions; the Resolution of the 4th session, 15th National Assembly. The closing session will be broadcast live on Voice of Vietnam, Vietnam Television, and National Assembly Television of Vietnam./.
