Regarding this issue, LawNet would like to answer as follows:
On July 20, 2023, the Vietnam Social Security issued Official Dispatch 2206/BHXH-TCKT on the payment of pensions, social insurance benefits, and monthly allowances for the August payment period, 2023.
Implementing Decree 42/2023/ND-CP on adjustment of pensions, social insurance benefits, and monthly benefits and Circular 06/2023/TT-BLDTBXH guiding the adjustment of pensions, social insurance benefits, and monthly benefits; Pursuant to Official Dispatch 5277/VPCP-KTTH dated July 13, 2023, of the Government Office on the early implementation of Decree 42/2023/ND-CP.
Since then, in order to ensure that people enjoy the policies specified in Decree 42/2023/ND-CP as soon as it come into effect, Vietnam Social Security has announced its plan to pay social insurance benefits in August 2023 as follows:
Organizing the payment of pensions, social insurance benefits, and monthly benefits for August 2023 and collecting the additional difference for July 2023 according to the new entitlement rates specified in Decree 42/2023/ND-CP and Circular 06/2023/TT-BLDTBXH from August 14, 2023.
Thus, from August 14, 2023, the payment of pension, social insurance benefits, and monthly benefits for the August payment period will be made.
According to Article 1 of Decree 42/2023/ND-CP, the following subjects are entitled to pension and social insurance benefits:
(i) Cadres, civil servants, workers, public employees, and employees (including those who have time to participate in voluntary social insurance, retirees from Nghe An farmer's social insurance fund who transfer according to Decision 41/2009/QD-TTg on converting social insurance of Nghe An farmers to voluntary social insurance); military personnel, people's police, and people doing cipher work are receiving monthly pensions.
(ii) Officials of communes, wards and townships specified in Decree 92/2009/ND-CP on titles, numbers, a number of regimes and policies for cadres and civil servants in communes, wards and townships and those working part-time at commune level, Decree 34/2019/ND-CP amending and supplementing a number of regulations on commune-level cadres and civil servants and part-time workers at commune level, in villages and residential quarters, Decree 121/2003/ND-CP on regimes and policies for cadres and civil servants in communes, wards and townships and Decree 09/1998/ND-CP amending and supplementing Decree 50/CP in 1995 on the living expenses regime for commune, ward and township officials who are enjoying monthly pensions and allowances.
(iii) Persons who are receiving monthly allowance for loss of working capacity as prescribed by law; people who are receiving monthly allowance under Decision 91/2000/QD-TTg on allowances for those who have reached the end of working age at the time of cessation of monthly working capacity loss allowance, Decision 613/QD-TTg on the monthly allowance for those who have from full 15 years to less than 20 years of actual work, the time limit for enjoying the loss of working capacity has expired;
Rubber workers are enjoying monthly allowances according to Decision 206-CP on policies for newly liberated workers who do heavy and unhealthy jobs, are now old and weak, and have to quit their jobs.
(iv) Commune, ward, and township officials who are receiving monthly allowances under Decision 130-CP supplementing policies and remuneration regimes for commune officials and Decision 111-HDBT amending a number of policies and regimes for commune and ward officials.
(v) Military personnel who are enjoying the monthly allowance under Decision 142/2008/QD-TTg on the implementation of the regime for soldiers participating in the resistance war against the US for national salvation with less than 20 years of service in the army and have been discharged and returned to their localities (amended Decision 38/2010/QD-TTg).
(vi) People's Public Security is receiving a monthly allowance under Decision 53/2010/QD-TTg on the regime for officers and soldiers of the People's Public Security who participated in the anti-American resistance war with less than 20 years of working in the People's Public Security, who have quit their jobs and returned to their localities.
(vii) Military personnel, people's police, and people doing cipher work receive salary like soldiers, people's police who are receiving monthly allowance under Decision 62/2011/QD-TTg on regimes and policies for those who participated in the war to defend the Fatherland, performed international missions in Cambodia, helped Laos friends after April 30, 1975, who were discharged from the army or quit their jobs after April 30, 1975.
(viii) Persons who are receiving a monthly labor accident and occupational disease allowance.
(ix) Persons receiving a monthly survivorship allowance before January 1, 1995.
The subjects specified at points (i), (ii), (iii), (iv), (v), (vi), and (vii) above who are entitled to pensions, social insurance benefits, and monthly benefits before January 1, 1995, after making adjustments as prescribed in Clause 1, Article 2 of Decree 42/2023/ND-CP, the pension, social insurance allowance, and monthly allowance are under VND 3,000,000/month.
