According to Article 27 of Decree 88/2022/ND-CP, offending the honor and dignity and infringing upon the bodies of teachers, managers, public employees, employees, and workers in vocational education institutions, violations of regulations on policies and regulations for teachers shall be penalized in Vietnam as follows:

(1) A fine ranging from VND 5,000,000 to VND 10,000,000 shall be imposed for offending the honor, dignity, or body of teachers, managers, officials, employees or employees in the institution. vocational education institution but not to the extent of criminal prosecution. (This penalty applies to individuals)

(2) A fine ranging from VND 10,000,000 to VND 15,000,000 shall be imposed for violations of policies towards teachers.

(3) A fine ranging from VND 15,000,000 to VND 20,000,000 shall be imposed for failing to conduct assessment and grading; failing to develop plans or organize professional and professional training and retraining; failing to arrange teachers to practice at enterprises or professional agencies as prescribed.

Remedial measures

- Forcing a public apology to the person whose honor and dignity are offended; physically infringing, for the violation specified in Clause (1), unless the person whose honor, dignity, or body is violated has a request not to publicly apologize;

- Forcible compliance with regulations on policies and regulations for teachers, for violations specified in Clauses (2) and (3).

Fine of up to VND 15 million for offending learners in vocational education institutions in Vietnam

According to Article 30 of Decree 88/2022/ND-CP, violating regulations on student discipline; offending the honor, dignity, and body of learners; Violations of regulations on policy for learners will be penalized as follows:

(1) A fine of VND 5,000,000 to 10,000,000 is imposed for any of the following acts:

- Disciplining learners not in accordance with regulations; At the same time, applying the remedial measure forces the cancellation of the disciplinary decision and restores the learner's right to study.

- Infringing upon the honor and dignity of the student, infringing upon the student's body but not to the extent of being prosecuted for criminal liability (this penalty applies to individuals).

At the same time, forcing a public apology to the student whose honor, dignity, or body has been violated for the violation, unless the student or his/her legal representative is insulted to his/her honor, dignity or body, and requests not to publicly apologize;

(2) A fine ranging from VND 10,000,000 to VND 15,000,000 shall be imposed for violations against regulations on policies towards learners.

At the same time, force the correct implementation of policies on learners for violations.

The statute of limitations for sanctioning administrative violations in the field of vocational education

The statute of limitations for sanctioning administrative violations in the field of vocational education is one year.

The time to calculate the statute of limitations for sanctioning administrative violations in the field of vocational education shall comply with the provisions of Points b, c, and d, Clause 1, Article 6 of the Law on Handling Administrative Violations.

The determination of the administrative violation has ended. The administrative violation is in progress to calculate the statute of limitations for sanctioning administrative violations according to the provisions of Clause 1, Article 8 of Decree 118/2021/ND-CP.

Decree 88/2022/ND-CP takes effect on December 12, 2022 and replaces Decree 79/2015/ND-CP.
