Enforced removal of violating works on the Vietnam’s network: New remedial measure

This is a remedial measure for administrative violations pertaining to culture, sports, tourism, and advertising newly regulated in Decree No. 28/2017/NĐ-CP of Vietnam’s Government.

Decree No. 28/2017/NĐ-CP of Vietnam’s Government has supplemented remedial measures as follows:

- Enforced satisfaction of requirements for facilities, equipment in film studios featuring special effects that affect moviegoers;

- Enforced removal of violating works in the electronic forms, on the network and digital environment;

- Enforced revocation of titles and prizes awarded to winners of beauty contests and model contests; certificates of eligibility for sports business; certificates of eligibility for antiques appraisal business; certificates of eligibility for relic rehabilitating practice; relic rehabilitating practice certificates; licenses to provide international travel services; tour guide’s cards; narrator’s certificates; licenses plates of tour vehicles;

- Enforced suspension of gaming centers, karaoke boxes, and dance clubs not in accordance with a certain distance as prescribed.

Different from the previous regulations, remedial measures for administrative violations pertaining to culture, sports, tourism, and advertising include:

- Forcible cancellation of the selection of athletes, ranking of athletes, trainers, referees of high-performance sports;

- Forcible cancellation of sports achievements;

- Forcible dismantlement of displays, signboards;

- Forcible return of land appropriated or termination of illegal use of historic sites, natural monuments, cultural or artistic works;

- Forcible return of swapped or appropriated documents to the library;

- Forcible dismantlement of removal or advertisements;

- Forcible offer of formal apologies;

- Forcible restoration of the initial state;

- Forcible dismantling of works, parts of works constructed without permits or not proper with permits;

- Forcible destruction of goods, articles which cause harms to human health, domestic animals and cultivated plants, environment and harmful cultural products;

- Forcible correction of false information or misleading;

- Forcible recall of products, goods without quality guarantee;

- Forcible submission of the unlawful profits from administrative violations or forced to submit the money equivalent to the value of material evidence, means used to commit administrative violations which have been sold, dispersed or destroyed contrary to the law provisions.
