1. Application Form for certificate of land use rights in Vietnam (Form No. 04a/DK)

The Application Form for certificate of land use rights (Form No. 04a/DK) is regulated under Circular 24/2014/TT-BTNMT.

2. Detailed Instructions for filling out the Application Form for certificate of land use rights in Vietnam

(1) Section "To":

- Provincial People's Committee where the land is located: Applicable for organizations, religious institutions; overseas Vietnamese, foreign-invested enterprises implementing investment projects; foreign organizations with diplomatic functions requesting certificate issuance.

- District People's Committee where the land is located: Applicable for households, individuals, community groups, overseas Vietnamese owning houses tied to homestead land usage rights in Vietnam requesting certificate issuance.

(According to Article 105 of the Land Law 2013).

(2) Section "Land user, owner of assets attached to land, land manager":

- Name section (in uppercase letters):

+ For individuals, write full name, year of birth, ID card number;

+ For households, write "Household of Mr." (or "Household of Mrs."), followed by full name, year of birth, ID card number (if any) of both spouses (those sharing the household’s land use rights).

+ For organizations, write name and establishment decision or business registration certificate, investment license (including name, number, signing date, signing authority).

+ For foreign individuals and overseas Vietnamese, write full name, year of birth, nationality, passport number, issue date, issuing place.

+ In cases of multiple owners jointly using the land, jointly owning assets, list the names of these owners in the attached list.

- Address section:

Write the permanent address of the household, individual as per the household registration booklet (if there is a new permanent address, it should be updated accordingly).

(3) Section "Request":

Organizations, households, individuals tick (v) the appropriate box according to their request.

Example: To request a certificate of land use rights, tick the box requesting certificate issuance for the land.

(4) Section "Registered parcel":

- In cases of registering multiple agricultural parcels without requesting a certificate or requesting a single certificate covering multiple agricultural parcels, only write the total number of parcels in this section and list each parcel in the attached list (Form 04c/DK).

- Subsection "Source of use":

Specify whether the land was granted by the state for a fee or without a fee, leased with a one-time payment, leased with annual payment, or other sources.

(5) Section "Assets attached to land": Only complete this section if certification of asset ownership is requested.

- Subsection “Houses, other construction works”:

+ Specify the type of house, construction work: single house, apartment, office, factory, warehouse, etc., and other relevant information such as construction area, floor area, number of floors...

+ In cases of multiple houses, construction works, only general information and total area of the houses, construction works are listed; a detailed list of houses, works is attached to the application.

- Subsection "Production forests are planted forests"; "Perennial plants":

For land areas with forests, provide detailed information about each type of forest, perennial plant.

(6) Section "Documents submitted with the application":

List the accompanying documents clearly, such as: original parcel sale contract (for purchased land), original VAT invoice, original financial obligation completion confirmation (if any), notarized household registration certificate...

(7) Section "Requirement to defer fulfillment of financial obligations": Organizations, households, individuals complete this section if needed.

(8) Section "Date, month, year":

The applicant writes the location, date of application, signs, and clearly states their full name (stamp if any).

Note: The remaining sections are for the authority's verification, the applicant should not complete these sections.
