Who are reserve Party members?  What are the rights of reserve Party members?

Who are reserve Party members? What are the rights of reserve Party members? Are reserve Party members that have been disciplined eligible to be considered official party members in Vietnam?

Hello, Lawnet would like to answer as follows:

1. Who are reserve Party members?

According to Article 1 of the Charter of the Communist Party of Vietnam 2011, “Members of the Communist Party of Vietnam are revolutionary soldiers in the vanguard of the working class, the laboring people, and the Vietnamese nation, striving throughout their lives for the purposes and ideals of the Party, put the interests of the Fatherland, the working class, and working people above personal interests; strictly comply with the Political Platform, Party Charter, Party resolutions, and State laws; have labor and complete assigned tasks well; have ethics and a healthy lifestyle; have close connections with the people; obey the Party's organization and discipline; and maintain unity within the Party."

Party members must meet the following conditions:

+ Be a Vietnamese citizen eighteen years of age or older;

+ Admit and voluntarily: implement the Political Platform, Party Charter, standards and tasks of party members, operate in a grassroots party organization; through practice, it has been proven that excellent people, trusted by the people, can be considered for admission to the Party.

At the same time, Article 5 of the Charter of the Communist Party of Vietnam 2011 stipulates:

"1. People admitted to the Party must undergo a twelve-month preparatory period, starting from the date the Party cell holds the admission ceremony. During the preparatory period, the Party cell continues to educate, train, and assign official party members to help that party member progress.

At the end of the preparatory period, the party cell considers recognizing official party members one by one and votes as when considering admission; If you do not qualify as a party member, you should request the competent party committee to decide to remove your name from the list of reserve party members."

Thus, reserve Party members are people who have been admitted to the Party but are not yet in the ranks of official Party members but will have 12 months of training and challenges to progress. At the end of the 12-month reserve period, reserve Party members will be considered and voted on to be admitted to the Party if they qualify as Party members.

If a reserve party member is not eligible for party membership, he or she shall request the competent party committee decide to remove his or her name from the list of reserve party members.

2. What are the rights of reserve Party members in Vietnam?

According to the provisions of Article 3 of the Charter of the Communist Party of Vietnam 2011, Party members have the following rights:

- Be informed and discuss issues about the Political Platform, Party Charter, guidelines, guidelines and policies of the Party; vote on the Party's work.

- Stand for, nominate, and elect leading agencies at all levels of the Party according to the regulations of the Central Executive Committee.

- Criticize and question the activities of party organizations and party members at all levels within the organization; report and make recommendations to responsible agencies; and request responses.

- Present opinions when the party organization comments, decides on work or enforces discipline against you.

Reserve Party members have the above rights, except the right to vote, run for office and elect the Party's leadership.

Thus, compared to official Party members, reserve Party members do not have the right to vote, run for office and elect the Party's leadership.

3. Are reserve Party members that have been disciplined eligible to be considered official party members in Vietnam?

According to the provisions of Clause 2, Article 1 of the Party Charter, a person admitted to the Party must undergo a 12-month preparatory period. At the end of the 12-month period, the following 2 cases will occur:

- Being considered for official Party membership if qualified as a Party member;

- Their name will be removed from the list of reserve Party members if you are not qualified as a Party member.

Thus, after the 12-month period, the reserve Party member, if qualified as a Party member, will be considered and voted to be admitted to the Party if qualified as a Party member.

In addition, Clause 10, Article 9, Regulation 22-QD/TW 2021 on principles of disciplinary enforcement within the Party stipulates: “Reserve Party members who commit violations that require disciplinary action will be reprimanded or warned. At the end of the reserve period, the Party cell will still consider recognition as official Party members. If the violation is to the extent that you are no longer eligible to be a party member, your name will be removed from the party membership list."

From the above regulations, it can be seen that reserve Party members who are disciplined will still be considered for official Party membership after their reserve period ends; unless their name is removed from the list of reserve Party members, they will not be considered to become official party members.
