1. What are rights and obligations of pledgors in Vietnam?

Based on the provisions set out in Articles 311 and 312 of the Civil Code 2015 regarding the rights and obligations of the pledgor:

* Rights of the pledgor:

- Request the pledgee to cease the use of the pledged property as stipulated in Clause 3, Article 314 of the Civil Code 2015 if such use poses a risk of loss or devaluation of the pledged property.

- Request the return of the pledged property and any related documents, if any, once the obligation secured by the pledge is fulfilled.

- Demand compensation from the pledgee for any damage to the pledged property.

- Be entitled to sell, replace, exchange, or gift the pledged property if agreed by the pledgee or as per legal provisions.

* Obligations of the pledgor:

- Deliver the pledged property to the pledgee as per the agreement.

- Inform the pledgee of any third-party rights concerning the pledged property, if applicable; failure to notify grants the pledgee the right to terminate the pledge contract and claim damages, or to maintain the contract while acknowledging the third party's rights.

- Pay the pledgee reasonable costs for safeguarding the pledged property unless otherwise agreed.
