What are penalties for the crime of murder to harvest victim's body parts according to the law in Vietnam?

According to Article 133 of the Vietnam Penal Code 2015 (amended and supplemented 2017), the penalty for murder is stipulated as follows:

(1) Anyone who commits murder in one of the following cases shall be subject to imprisonment from 12 years to 20 years, life imprisonment, or death penalty:

- Killing 02 or more people;

- Killing a person under 16 years old;

- Killing a woman known to be pregnant;

- Killing a person performing official duties or due to the official duties of the victim;

- Killing one's own grandparent, parent, guardian, teacher, or educator;

- Committing murder either immediately before or immediately after committing a very serious or especially serious crime;

- To commit or conceal another crime;

- To harvest the victim's organs;

- Committing the crime in a brutal manner;

- By exploiting professional skills;

- By methods capable of causing the death of many people;

- Hiring murder or being hired to murder;

- With a hooligan nature;

- With an organized group;

- Recidivism of dangerous nature;

- Due to despicable motives.

(2) Committing the crime not falling into the cases specified in Clause 1, Article 133 of the Vietnam Penal Code 2015 (amended and supplemented 2017) shall be subject to imprisonment from 07 years to 15 years.

(3) Those who prepare to commit this crime shall be subject to imprisonment from 01 year to 05 years.

(4) The offender may also be prohibited from practicing a profession or performing certain jobs from 01 year to 05 years, enforced residence, or banned from residing from 01 year to 05 years.

Thus, an offender who commits murder to harvest the victim's organs can be sentenced to imprisonment from 12 years to 20 years, life imprisonment, or the death penalty, depending on the nature and degree of danger to society.

Additionally, the offender may also be prohibited from practicing a profession or performing certain jobs from 01 year to 05 years, enforced residence, or banned from residing from 01 year to 05 years.
