Based on Article 2, Clause 1 of the Party Charter of the Communist Party of Vietnam in 2011, the following regulations apply:
Vietnamese citizens from the age of eighteen and above who acknowledge and voluntarily commit to implementing the Party's political line, Party Charter, criteria and tasks of Party members, and engage in activities within a Party grassroots organization, and those who have demonstrated outstanding qualities and gained the trust of the people, can be considered for Party membership.
According to the guidance provided in Section 1 of Decision 24-QD/TW in 2021, the regulations on age and educational qualifications for joining the party are as follows:
- Regarding age:
+ At the time of the Party cell's consideration for admission, individuals must be between eighteen and sixty years old (calculated by month).
+ The admission of individuals over sixty years old is subject to consideration and decision by the Central- level Party committee.
- Regarding educational qualifications:
+ Individuals joining the Party must have at least a high school diploma or its equivalent.
+ The educational qualifications of individuals joining the Party who reside in mountainous areas, islands, areas with ethnic minority populations, and economically and socially disadvantaged areas, as well as other specific cases that do not meet the general requirements due to Party development needs, shall be implemented according to the guidance of the Party's Central Committee.
Therefore, based on the regulations regarding age and educational qualifications for joining the Party, if you have not graduated from high school, you can still be considered for Party membership if you meet the conditions specified.
Cases of Party members leaving the Party include:
- Cases of removal of Party membership, including the cases specified in Section 8 of Decision 24- QD/TW in 2021:
+ Party members who cease Party activities or fail to pay Party dues for three consecutive months without valid reasons.
+ Party members who voluntarily return their Party membership cards or cancel their Party membership cards.
+ Party members who show a decline in their will to strive, fail to fulfill their Party member duties, and do not make progress within 12 months after being educated by the Party cell.
+ Party members who violate Party member qualifications for two consecutive years; Party members who do not meet the political standards as prescribed by the Politburo.
- Cases of expulsion of Party members: This is a form of disciplinary action for Party members who commit serious violations, as specified in Section 9, Article 2 of Decision 69-QD/TW in 2022, including the following violations:
+ Party members who commit violations of the law must be strictly handled according to the provisions of the law.
+ Party members who commit law violations to the extent of being subject to criminal liability, wanted by the authorities, or sentenced to non- custodial reform penalties or higher.
Based on Section 3 of Decision 24-QD/TW in 2021, there are regulations regarding readmission of individuals to the Party:
3.5. Regarding readmission to the Party.
3.5.1. Individuals considered for readmission must meet the following conditions:
a) They must meet the conditions and criteria for joining the Party as specified in Article 1 of the Party Charter.
b) At least 36 months have passed since their departure from the Party (except for individuals who have been convicted of less serious crimes, in which case it must be at least 60 months after their criminal record has been expunged; for Party members who have been expelled due to violations of population and family planning policies, the provisions of the Party Central Committee shall apply), and they must submit a written application for readmission to the Party. The approval of the provincial or municipal Party Standing Committee (or equivalent) and the competent Party Committee (district Party Committee or equivalent) is required for consideration and decision.
c) They must follow the procedures specified in Clauses 1, 2, and 3 of Article 4 of the Party Charter.
3.5.2. Excluded individuals will not be considered for readmission.
Individuals who have previously left the Party due to reasons such as voluntarily ceasing Party activities, submitting a request to leave the Party (except for cases of special family difficulties), causing serious internal division, being convicted of corruption, or being convicted of serious crimes or above will not be considered for readmission.
Therefore, individuals who have previously left the Party can be considered for readmission if they meet the conditions for readmission and do not fall into any of the cases that are not eligible for readmission. However, readmission is only allowed once. If they leave the Party again, they will not be readmitted.
3. Are relatives of expelled Party members eligible to be admitted to the Party in Vietnam?
Currently, there is no official regulation stating that relatives of individuals who have been expelled from the Party cannot be admitted to the Party. The specific conditions for Party admission, as stipulated in the Party Charter of the Communist Party of Vietnam in 2011 and Decision 24-QD/TW in 2021, require strict scrutiny of the background not only of the individual applying for Party membership but also of their relatives.
The scrutiny process will include the following issues:
- Political history and current political stance.
- Compliance with the Party's line, policies, and the laws of the State.
- Political qualities, ethics, and lifestyle.
