Circular 65/2023/TT-BCA: Head of professional Public Security department of the People's Public Security to have competence to sanction administrative violations from January 1, 2024 in Vietnam

On November 17, 2023, the Ministry of Public Security issued Circular 65/2023/TT-BCA
Regarding the head of the professional police department of the People's Public Security, he/she has the authority to sanction administrative violations in the fields of security, order, and social safety; prevention of social evils; fire protection and prevention; rescue and rescue; and domestic violence prevention and control.

1. Head of the Peope's Public Security's professional department to have the authority to sanction administrative violations from January 1, 2024 in Vietnam

Circular 65/2023/TT-BCA stipulates the authority to sanction administrative violations in the fields of security, order, and social safety; Prevention of social evils; fire protection and prevention; rescue and rescue; Prevention and control of domestic violence by the Head of the Professional Department of the Department of Internal Political Security; Police Department of Administrative Management on Social Order; Traffic Police Department; Police Department of Fire Prevention, Fire Prevention and Rescue and Rescue; Department of Cyber Security and Crime Prevention and Control using high technology; Administration of Immigration.

Circular 65/2023/TT-BCA applies to the following objects:

+ The titles are competent to sanction administrative violations specified in Article 3 of Circular 65/2023/TT-BCA.

+ Vietnamese individuals and organizations; foreign individuals and organizations (hereinafter reflected as individuals and organizations) are sanctioned administrative violations in the field of security, order, and social safety; Prevention of social evils; fire protection and prevention; rescue and rescue; Domestic violence prevention and control

+ Individuals and organizations involved in sanctioning administrative violations in the fields of security, order, and social safety; prevention of social evils; fire protection and prevention; rescue and rescue; and domestic violence prevention and control.

2. The title of Head of the people's public security's professional department to have the authority to sanction administrative violations

In Article 3 of Circular 65/2023/TT-BCA, it is provided for the position of Head of the CAND's professional department with the authority to sanction administrative violations in the fields of security, order, and social safety; prevention of social evils; fire protection and prevention; rescue and rescue; Domestic violence prevention and control includes:

- Head of professional department of the Department of Internal Political Security includes:

+Head of internal protection departments of Party and State agencies;

+ Head of the Security Department of judicial agencies, formulating laws, and socio -political organizations;

+ Head of Press Security and Publishing;

+ Head of Health and Education Security Division;

+ Head of Cultural Security, Sports and Social Labor;

+ Head of Post, Telecommunications and Information Technology;

+ Head of state management department on protecting state secrets.

- Head of the Professional Department of the Police Department of Administrative Management on Social Order includes:

+ Head of guiding and managing weapons, explosives, support tools and firecrackers;

+ Head of the Department of Guidance and Management of business investment industries and industries with conditions for security, order and seal;

+ Director of National Data Center on population.

- Head of the professional department of the Traffic Police Department includes:

+ Head of the Department of Instructing, propagating, investigating and resolving traffic accidents;

+ Head of Department of Instruction, Registration, and Testing of vehicles;

+ Head of the Department of Guidance, Training, Testing, and Management of License of the driver of the vehicle;

+ Head of guidance on patrol and control of road and rail traffic;

+ Head of traffic control and delegation;

+ The Head of the Department guides patrolling, controlling, and fighting against crime on inland waterways;

+ Crew chief.

- Head of professional department of the Fire Prevention, Fire and Rescue Police Department includes:

+ Head of fire prevention and prevention work;

+ Head of jurors for fire prevention and fighting;

+ Head of fire fighting and rescue work;

+ Head of Science and Technology Management and inspection of fire prevention, fighting, rescue, and rescue means.

- Head of Professional Department of the Department of Cyber Security and High -tech Crime Prevention and Control includes:

+ Head of Crime Prevention and Control using cyberspace to violate economic management order;

+ Head of Crime Prevention and Control using cyberspace to violate social order;

+ Head of network information security; Head of the National Information and Security Protection Department;

+ Head of network information supervision and prevention and control of cyberspace operations violating national security.

- Head of the Professional Department of the Immigration Department includes:

+ Head of entry, exit, and residence management departments for foreigners;

+ Head of exit and entry management department of Vietnamese citizens.

Circular 65/2023/TT-BCA will officially take effect on January 1, 2024, and replace Circular 10/2015/TT-BCA dated 11/02/2015.
