12 Judgment applying precedence 06/2016/AL on inheritance disputes in Vietnam

Inheritance is the legal right of the heir to the estate left by the deceased. However, in many cases, due to conflicts and disagreements between the heirs, disputes arise, which cannot be self-reconciled and need to be resolved by the Court. For disputes that have not been provided for by any law, according to procedural principles, the Court must not refuse but must apply case law to settle the case. In the case of a dispute involving an heir in a foreign country but the Court cannot determine the address of such person, precedence 06/2016/AL shall apply to settle the claim of the plaintiff, the part of the inherited property. Those who are absent, whose addresses cannot be determined will be temporarily assigned to people living in the country for management to later be handed over to the absent heirs.
