Secondary schools are institutions providing general education in the national educational system. Each secondary school has legal status and a separate account and stamp. Currently, the latestupper secondary school charter are issued together with Circular 32/2020/TT-BGDDT.

What are duties and powers of the upper secondary schools in Vietnam?
Based on Article 3 of the Regulations for lower secondary schools, upper secondary schools, and schools with multiple levels published together with Circular 32/2020/TT-BGDDT, 12 duties and rights of upper secondary schools include:

Developing the school’s development strategy, plan in connection with local socio-economic conditions; determining the vision, mission, core values of education, culture, history, and traditions of the school.

Developing and implementing the school's educational plan according to the general education program issued by the Minister of Education and Training. Coordinating with students’ families, organizations, and individuals to organize educational activities.

Enrolling and admitting students, managing students following the Ministry of Education and Training’s regulations.

Implementing the plan for universal education within the assigned scope.

Organizing teachers, staff, and students to participate in social activities.

Managing teachers and staff in accordance with the law.

Mobilizing, managing, and using resources for educational activities in compliance with the law.

Managing, using, and preserving physical facilities and equipment in accordance with the law.

What are types of upper secondary schools in Vietnam?
Based on Article 4 of the Regulations for secondary schools, upper secondary schools, and schools with multiple levels issued together with Circular 32/2020/TT-BGDDT, the types and systems of upper secondary schools in Vietnam are specified as follows:
Secondary school types and systems
1. There are two types of secondary schools: public schools and private schools.
a) A public secondary school is established and directly managed by the competent authority. The school’s facilities and recurrent expenditures are mostly covered by state budget.
b) A private secondary school has its establishment invested in and operating conditions guaranteed by a foreign or Vietnamese investor and is established under the law. The school’s facilities and operating expenses are not covered by state budget.

Article 9 of the Regulations for secondary schools, upper secondary schools, and schools with multiple levels issued together with Circular 32/2020/TT-BGDDT, specifies that organizational structure of a secondary school comprises the school council; principal and deputy principal(s); emulation and reward council; discipline councils; advisory councils; affiliate of the Communist Party of Vietnam; affiliate of trade union; affiliate of Ho Chi Minh Communist Youth Union; affiliate of Ho Chi Minh Young Pioneer Organization; specialized teams; office team; and units in charge of educational activities characteristic of the school.
According to point b, clause 1, and point b, clause 2 of Article 10 of the Regulations for secondary schools, upper secondary schools, and schools with multiple levels issued together with Circular 32/2020/TT-BGDDT, the upper secondary school council includes:
The school council of public upper secondary schools shall be composed of the secretary of the Party Executive Committee; school principal; chairperson of trade union; secretary of the Ho Chi Minh Communist Youth Union, representatives of specialized teams and office team; and representatives of the local government, parent committees and students.
The school council of private upper secondary schools shall be composed of investor representatives and in-school and out-school members elected in an investor conference and decided based on capital contribution percentage.
