a) Educational quality accreditation organizations established by the State operate according to State regulations for public service providers.
b) Educational quality accreditation organizations established by organizations or individuals operate according to State regulations for non-public organizations operating in the education and training sectors.
- Educational quality accreditation organizations have legal status; have their own accounts and seals; have transaction offices; operate independently of educational institutions.

What are the functions, tasks, and responsibilities of the educational quality accreditation organization in Vietnam?
Pursuant to Article 13 of the Regulations on the conditions for establishment and dissolution, tasks, and powers of educational quality accreditation organizations issued together with Circular 61/2012/TT-BGDDT, the functions, tasks, and responsibilities of educational quality accreditation organizations are as follows:
- The educational quality accreditation organization has the following functions:
+ Organize activities for evaluating and recognizing educational institutions and educational programs that meet educational quality standards;
+ Advise educational institutions on enhancing their quality after being accredited.
- The educational quality accreditation organization has the following tasks:
+ Publicly announce the decision to establish or permit the establishment of the educational quality accreditation organization, the license for quality accreditation activities, the organizational and operational regulations of the educational quality accreditation organization, and the list of inspectors on its website and other public media;
+ At least 30 days before the license for quality accreditation activities expires, if there is a need to continue operations, the educational quality accreditation organization must submit a written request to the Ministry of Education and Training for renewal of the license for quality accreditation activities;
+ Comply with the regulations on educational quality standards, quality accreditation procedures; principles of operation, conditions, and standards of organizations and individuals involved in quality accreditation;
+ Organize quality accreditation activities according to the targets and scope stated in the quality accreditation license;
+ Provide educational quality accreditation consulting services to educational institutions; fulfill all terms in the consulting service contract signed with educational institutions; take responsibility for professional activities carried out by the educational quality accreditation organization;
+ Manage inspectors, officers, and employees of the educational quality accreditation organization;
+ Manage finances, ensure compliance with current legal provisions;
+ Annually, by December 31, submit a written report to the Ministry of Education and Training, including the status of quality accreditation activities; changes during the year, advantages, difficulties, recommendations, and other information that needs to be provided to the Ministry of Education and Training.
- The educational quality accreditation organization has the following responsibilities:
+ Be accountable to the law, to the educational institution registered for quality accreditation, and to organizations and individuals using the quality accreditation results for the services provided;
+ Purchase professional liability insurance for inspectors, set up a professional risk reserve fund as prescribed by the Ministry of Finance;
+ Compensate for damages caused by the educational quality accreditation organization's errors to the educational institution registered for quality accreditation during the implementation of quality accreditation services and other related services; compensation levels are to be agreed upon by both parties or decided by a competent authority in dispute resolution;
+ During the implementation of quality accreditation activities, if a violation of the law is found at the educational institution registered for quality accreditation, the educational quality accreditation organization must notify the registered institution, the Ministry of Education and Training, and the direct management agency of the registered institution;
+ Provide quality accreditation documents and materials as requested in writing by a competent state authority as prescribed by law;
+ Be civilly liable as prescribed by law; do not allow any individual or organization to misuse the name and facilities of the educational quality accreditation organization to conduct quality accreditation activities.
What are powers of educational quality accreditation organizations in Vietnam?
Pursuant to Article 14 of the Regulations on the conditions for establishment and dissolution, tasks, and powers of educational quality accreditation organizations issued together with Circular 61/2012/TT-BGDDT, the educational quality accreditation organization has the following powers:
- To carry out the activities stated in the quality accreditation license.
- Hire domestic and foreign experts to cooperate with inspectors in implementing service contracts or collaborating with other educational quality accreditation organizations as prescribed by law.
- Participate in professional organizations on educational quality accreditation both domestically and internationally.
- Request the educational institution registered for quality accreditation to provide promptly necessary documents and information related to quality accreditation activities.
- Verify and confirm information and evidence related to the institution registered for quality accreditation.
- Propose competent units or individuals to provide expertise or consultancy related to quality accreditation activities.
- Have the right to refuse to provide educational quality accreditation services.
- Exercise other rights as prescribed by law.
