At what grade are students in Vietnam considered children?
According to Article 1 of the Children's Law 2016, children are persons under 16 years of age.
Based on the regulations in Article 28 of the Education Law 2019:
Levels and Age of General Education
1. The levels and age of general education are regulated as follows:
a) Primary education is conducted over 5 academic years, from grade one to the end of grade five. Students enter grade one at the age of 6, calculated by year;
b) Secondary education is conducted over 4 academic years, from grade six to the end of grade nine. Students enter grade six having completed primary education. They start grade six at the age of 11, calculated by year;
c) High school education is conducted over 3 academic years, from grade ten to the end of grade twelve. Students enter grade ten having a junior high school diploma. They start grade ten at the age of 15, calculated by year.
2. Exceptions to the prescribed age range in section 1 of this Article include:
a) Students advancing grades if they are early intellectual achievers;
b) Students older than the prescribed age range if they are held back, in economically disadvantaged areas, minority students, students with disabilities, students with physical or mental developmental delays, orphans, students from poor households, students returning from abroad, or other cases according to the law.

What are the guidelines for organizing the Mid-Autumn Festival 2024 for children in Vietnam?
On July 15, 2024, the Ministry of Labor, War Invalids, and Social Affairs issued Official Dispatch 3099/BLDTBXH-CTE 2024 regarding the organization of the Mid-Autumn Festival 2024. Specifically, the organization of the Mid-Autumn Festival 2024 is as follows:
Organizing the Mid-Autumn Festival for children is a beautiful tradition of the Vietnamese people.
To ensure that children nationwide can enjoy the Mid-Autumn Festival 2024, the Ministry of Labor, War Invalids, and Social Affairs requests that the People's Committees of provinces and centrally-governed cities direct their provincial departments and authorities and local People's Committees on the following points:
- Allocate funds from the state budget; mobilize resources from organizations and individuals to visit and give Mid-Autumn Festival gifts to children;
Pay special attention to children in special circumstances, children from poor and near-poor households, children in minority areas, remote and isolated areas, border areas, islands, orphans, and children affected by natural disasters and epidemics.
- Direct the Department of Labor, War Invalids, and Social Affairs to cooperate with provincial departments and authorities and relevant units to organize safe, healthy, practical, and economical activities for children to enjoy the Mid-Autumn Festival;
Coordinate activities that combine traditional Mid-Autumn Festival values with tourism promotion events, cultural products, and local culinary specialties.
Encourage organizing recreational activities that attract and provide opportunities for children in special circumstances and children in economically difficult areas to participate.
- Focus on protecting children's health, especially food safety and hygiene;
Protect children from the influence of violent, educationally inappropriate, low-quality, toxic, dangerous products, and games not suitable for children.
Report the results of the Mid-Autumn Festival activities for children (attached appendix) to the Ministry of Labor, War Invalids, and Social Affairs (via the Department of Children, 35 Tran Phu, Ba Dinh District, Hanoi; phone: 024.37475628) before September 27, 2024.
