Pursuant to Clause 1, Article 29 of Decree 125/2024/ND-CP, a lower secondary school is suspended from educational activities in any of the following cases:

- Engaging in fraudulent conduct to obtain permission for educational activities;

- Authorized permission for educational activities is not obtained through proper authority;

- Failing to commence educational activities within one year from the date of granted educational activity permission;

- Violating educational regulations resulting in administrative penalties at a level requiring suspension of educational activities;

- Other violations as stipulated by law.

What are procedures for suspending educational activities of a lower secondary school in Vietnam?

According to Clause 3, Article 29 of Decree 125/2024/ND-CP, the procedures for suspending educational activities of a lower secondary school in Vietnam are carried out as follows:

- Upon discovering violations as specified in Clause 1, Article 29 of Decree 125/2024/ND-CP, the Head of the Department of Education and Training or the Director of the Department of Education and Training will organize an inspection to evaluate the actual state of the school, document the inspection findings, and notify the school of the violations;

- Within 15 days from the date of notifying the school of the violation, the Head of the Department of Education and Training or the Director of the Department of Education and Training, based on the extent of the violation, decides to suspend the school's educational activities and reports to the authority responsible for establishing or permitting the establishment of the school.

The decision to suspend educational activities for the lower secondary school (as per Form No. 10 Appendix I attached to Decree 125/2024/ND-CP) is publicly announced through mass media;

- During the suspension period, if the cause of the suspension is rectified, the school submits a written notice along with evidence to the Head of the Department of Education and Training or the Director of the Department of Education and Training. Within 7 working days from receiving the school's notice, the Head of the Department of Education and Training or the Director of the Department of Education and Training decides on reinstating the school's educational activities and publicly announces it through mass media;

- In cases suspended according to point b, Clause 1, Article 29 of Decree 125/2024/ND-CP, within 5 working days from the date of suspension decision, the Head of the Department of Education and Training or the Director of the Department of Education and Training reviews the educational operation conditions of the school. If the conditions meet the requirements set in Article 27 of Decree 125/2024/ND-CP, they will decide on allowing the school to resume educational activities and publicly announce it through mass media.

Will a lower secondary school in Vietnam be dissolved if the suspension period of educational activities ends?

According to Clause 1, Article 31 of Decree 125/2024/ND-CP:

  1. A lower secondary school will be dissolved if it falls into one of the cases stipulated in Clause 2, Article 51 of the Education Law.
  1. The Chairman of the district-level People's Committee decides on the dissolution of a lower secondary school; The Chairman of the provincial-level People's Committee decides on the dissolution of a high school.

Additionally, according to Clause 2, Article 51 of the Education Law 2019 on the merger, division, separation, and dissolution of schools:

  1. A school will be dissolved in the following cases:

a) Severe violations of regulations on management, organization, and operation of the school;

b) Failing to rectify the causes leading to the suspension after the suspension period of educational activities has ended;

c) The goals and content of activities in the decision to establish or permit the establishment of the school no longer align with economic-social development needs;

d) Inability to ensure educational quality;

e) Upon the request of the organization or individual that established the school.

From the above regulations, if a lower secondary school fails to resolve the issues leading to suspension before the suspension period ends, it will be dissolved.
