What are international students under state budget scholarship of Vietnam?

Based on Clause 1, Article 3 of Decree 86/2021/ND-CP, an international student under state budget scholarship is a Vietnamese citizen studying abroad who receives full or partial funding for tuition, travel expenses, living expenses, and other related costs from one or more of the following financial sources:

- Scholarships funded by the state budget within the framework of agreements or cooperation between the Government of Vietnam and the government of a foreign country;

- Scholarships funded by the state budget through state agencies, state-owned enterprises, or public service providers;

- Scholarships funded by the government of a foreign country, official development assistance (ODA), territorial governments, international organizations, non-governmental organizations, or individuals via the Government of Vietnam (collectively referred to as foreign-funded scholarships).

According to Clause 2, Article 6 of Decree 86/2021/ND-CP regulating the rights and responsibilities of international students under state budget scholarship:

2. Responsibilities of international students under state budget scholarship

a) Strictly comply with Vietnamese law, the laws and customs of the host country; in case of violations, depending on the nature and severity, they will be handled according to the laws of the relevant parties;

b) Strictly comply with the rules and regulations of the foreign educational institution and the commitments or regulations of the direct managing agency (for those with a working agency), and the dispatching agency; maintain and develop friendly relations with organizations, individuals, and the local community of the host country;

c) Register as a Vietnamese citizen abroad according to current regulations and update information into the database system as specified in Article 4 of this Decree;

d) Not arbitrarily drop out of school; comply with the duration of study, training level, field of study, host country, and educational institution according to the decision of the competent authority to study abroad;

dd) Notify the dispatching agency at least 10 working days before returning to Vietnam for internships, researching materials, taking leave, or vacations according to the regulations of the foreign educational institution for the circumstances specified in points a and b, Clause 1, Article 3 of this Decree;

e) Submit a study progress report (Form No. 01 in the Appendix issued with this Decree) and a certified copy of academic results from the foreign educational institution by mail, or directly, or online to the dispatching agency after each semester or academic year;

g) Must return training costs according to the provisions of Articles 12 and 13 of this Decree if they do not complete their study obligations or do not comply with the work assignment by the competent state agency after graduation for students specified in points a and b, Clause 1, Article 3 of this Decree;

h) Comply with current regulations concerning officials and public employees and the regulations of the Communist Party (for those who are officials and public employees and party members);

i) Protect documents and information classified as state secrets as stipulated in the Law on State Secret Protection, information on political protection internally;

k) Not use studying or any other form as a means to engage in activities against the Vietnamese state, affecting the diplomatic relations between Vietnam and the partner country.

Thus, international students under state budget scholarship must return training costs if they do not complete their study obligations or do not comply with the work assignment of the competent state agency after graduation.

What are the rights of international students under state budget scholarship of Vietnam?

According to Clause 1, Article 6 of Decree 86/2021/ND-CP, international students under state budget scholarship have the following rights:

- The right to return to Vietnam for internships, to gather documents for their study program; to enjoy holidays during their study time as per the regulations of the foreign educational institution; to return to Vietnam or visit relatives in another country (third country) if agreed by the competent authority of the host country;

- The protection of legitimate rights by Vietnamese representatives abroad during their study time overseas according to regulations;

- To receive full or partial tuition, travel expenses, living expenses, and other related costs for studying abroad from the state budget for students specified in points a and b, Clause 1, Article 3 of this Decree or funded by the foreign party for students specified in point c, Clause 1, Article 3 of Decree 86/2021/ND-CP.
