What issues must be clarified in the proposal to establish a private preschool in Vietnam?
Based on Clause 2, Article 3 of Decree 46/2017/ND-CP providing for requirements for establishing private preschools, as follows:
requirements for establishing public kindergartens, preschools, and daycare centers; permitting the establishment of people's, private kindergartens, preschools, and daycare centers
- There must be a proposal for establishing a kindergarten, preschool, or daycare center that aligns with the socio-economic development plan and local educational network plan, which has been approved by the competent state management authority.
- The proposal to establish a kindergarten, preschool, or daycare center must clearly define the objectives, tasks, programs, and educational content; the land, infrastructure, equipment, proposed location for building the school; the organizational structure, resources, and finances; strategic direction for construction and development.
To permit the establishment of a private preschool, there must be a proposal for establishing a preschool that aligns with the socio-economic development plan and the local educational network plan, which has been approved by the competent state management authority.
The proposal to establish a private preschool must clearly address the following issues:
- Clearly define the objectives, tasks, programs, and educational content;
- Land, infrastructure, equipment, and proposed location for building the school;
- Organizational structure, resources, and finances; strategic direction for construction and development.
What are procedures for establishmet of a private preschool in Vietnam?
Based on Clause 3, Article 4 of Decree 46/2017/ND-CP, as amended by Clause 1, Article 1 of Decree 135/2018/ND-CP, the procedures for permitting the establishment of a private preschool are as follows:
Step 1: Submit the application
Organizations or individuals requesting the establishment of a private preschool should submit directly or through the postal service one set of application documents to the District-level People’s Committee.
The application should include:
- A submission letter requesting the establishment of the private preschool, clearly stating the necessity of establishment; the name of the preschool; the proposed location for the headquarters to carry out nurturing, caring, and educating children;
- The proposal for establishing the private preschool;
Step 2: Assess the application
Within 5 working days from the date of receipt of a complete valid application, the District-level People’s Committee is responsible for instructing the Education and Training Department to organize an assessment of the requirements for establishing the preschool;
Within 15 working days, the Education and Training Department, in cooperation with related specialized departments, will make a review and submit their assessment to the Chairman of the District-level People’s Committee;
Step 3: Consideration and decision on the establishment of the preschool
Within 5 working days from the date of receipt of the written assessment from the Education and Training Department and related specialized departments, if the requirements are met as stipulated, the Chairman of the District-level People’s Committee will issue a decision allowing the establishment of the preschool;
If the requirements are not met, the Chairman of the District-level People’s Committee will provide a written response detailing the reasons.
*Note: After a period of 2 years from the effective date of the decision permitting the establishment, if the preschool is not permitted to operate educational activities, the decision allowing the establishment or permitting the establishment will be annulled.
In addition, the Chairman of the district, town, city, and district-level towns within a province has the authority to permit the establishment of a private preschool. (Based on Clause 1, Article 4 of Decree 46/2017/ND-CP)

What are requirements for educational operations of a private preschool in Vietnam?
According to the provisions in Article 5 of Decree 46/2017/ND-CP, as amended by Clause 2, Article 1 of Decree 135/2018/ND-CP, the requirements for educational operations of a private preschool are as follows:
[1]. A decision permitting the establishment issued by the Chairman of the District-level People’s Committee.
[2]. Land, school premises, facilities, and equipment that meet the requirements for maintaining and developing educational activities, specifically:
- The preschool must be located in a residential area ensuring safety regulations and environmental sanitation;
- The area of land includes: construction area; playground area; greenery, and walkways.
The minimum average land area is 12 square meters per child for plains and midland regions (excluding cities and district-level towns); 08 square meters per child for cities, district-level towns, mountainous, and island areas;
In areas with limited land, construction area may be replaced with floor area, provided it meets the required area.
* Specifically, a private preschool can:
- Lease school premises, facilities, and equipment from the State or unused public educational institutions to organize educational activities as stipulated by law.
- Lease part or all State-owned houses and infrastructure to organize educational activities as stipulated by the Government of Vietnam in encouraging private investment in education, vocational training, healthcare, culture, sports, environment, and judicial assessment.
In the case of leasing underutilized educational equipment from public service units, it must comply with the regulations on the management and use of State assets.
- The preschool campus must have a boundary wall separating it from the outside;
- The structure of the school building includes:
+ Building block for kindergarten groups and classes: Activity room, sleeping room, restroom, play porch in accordance with standard regulations;
+ Study service rooms: Physical education room, art education room, or multifunctional room;
+ Food service block: Kitchen area and warehouse;
+ Administrative management block: School office, principal’s office, vice-principal’s office, administrative management room, medical room, security room, staff room, restroom for teachers and staff, parking area for teachers and staff;
+ Playground includes: Group and class playground; common playground.
- Facilities, toys, tools, and educational materials for nurturing and educating children as stipulated by the Ministry of Education and Training.
[3]. A sufficient number of managerial staff, teachers, and employees in appropriate structure and meeting standards to ensure the implementation of the preschool education program and organization of educational activities.
[4]. Sufficient financial resources as stipulated to ensure the maintenance and development of educational activities.
[5]. Organizational and operational regulations of the preschool.
