Which agency decides on the establishment of lower secondary schools in Vietnam?

Article 6 of the regulations for lower secondary schools, upper secondary schools, and schools with multiple levels issued with Circular 32/2020/TT-BGDDT stipulates as follows:

Management Decentralization

1. lower secondary schools and schools with multiple levels, where the highest level is lower secondary school, are established by the Chairman of the District People's Committee and managed by the District People's Committee.

2. Upper secondary schools and schools with multiple levels, where the highest level is upper secondary school, are established by the Chairman of the Provincial People's Committee and managed by the Department of Education and Training. The Department of Education and Training cooperates with the District People's Committee to build content for management coordination and organize related educational activities for schools with multiple levels, where the highest level is upper secondary school.

3. Specialized schools with specific organizational and operational regulations follow the management decentralization as per their organizational and operational regulations.

Thus, the Chairman of the District People's Committee and the Chairman of the Provincial People's Committee decide on the establishment of specific lower secondary schools:

- Lower secondary schools and schools with multiple levels, where the highest level is lower secondary school, are established by the Chairman of the District People's Committee.

- Upper secondary schools and schools with multiple levels, where the highest level is upper secondary school, are established by the Chairman of the Provincial People's Committee.

Do private lower secondary schools establish a school council?

Based on Article 9 of the regulations for lower secondary schools, upper secondary schools, and schools with multiple levels issued with Circular 32/2020/TT-BGDDT:

The organizational structure of lower secondary schools includes: school council; principal and vice-principal; commendation and reward council; disciplinary council; advisory council; Communist Party of Vietnam organization; Trade Union organization; Ho Chi Minh Communist Youth Union organization; Ho Chi Minh Young Pioneer organization; professional groups; administrative office; classrooms; service groups for the special educational activities of specialized schools.

2. The school council of private lower secondary schools:

a) The school council of private lower secondary schools is the school's administrative organization, representing the rights of the investors and involved parties, and is responsible for implementing the decisions of the investors.

b) The composition of the school council includes representatives of the investors, members from both within and outside the school elected based on the proportion of capital contribution.

For non-profit private schools, the council comprises representatives of investors elected based on the proportion of capital contribution, members from both within and outside the school. Internal members include the ex officio members such as the party secretary, principal, Trade Union president, Ho Chi Minh Communist Youth Union secretary; elected members representing teachers and staff elected by the general meeting or the school representative conference. External members include representatives of leaders, managers, educators, entrepreneurs, alumni elected by the general meeting or the school representative conference.

c) The duties, powers, and procedures for the establishment and operation of the school council for private lower secondary schools follow the organizational and operational regulations of private lower secondary schools issued by the Minister of Education and Training.

Thus, private lower secondary schools will also have a school council. The school council of private lower secondary schools is the school's administrative organization, representing the investors and involved parties and is responsible for implementing the decisions of the investors.
