What is the teaching hour norm in vocational education institutions in Vietnam?

Based on Article 2 of Circular 07/2017/TT-BLDTBXH (amended by Clause 2 Article 2 of Circular 28/2022/TT-BLDTBXH), the following regulations are provided:

Standard hour, teaching time, and workload

1. A standard hour is the unit of time converted from the necessary working hours before, during, and after the teaching hour to complete the task of direct or online teaching. One standard hour of online teaching is counted the same as one standard hour of direct teaching.

A standard hour is calculated for theoretical teaching not exceeding 35 students; for practical or integrated teaching not exceeding 18 students; for teaching heavy, hazardous, dangerous trades according to the list issued by the Minister of Labor - Invalids and Social Affairs not exceeding 10 students. The principal, director of vocational education institutions, vocational education centers - continuing education centers, shall base on the specific number of students in the class to convert standard hours ensuring compliance with practical conditions and the characteristics of each trade.

2. Teaching time in the training plan is calculated by standard hours, including:

a) One theoretical teaching hour is 45 minutes counted as 01 standard hour;

b) One integrated teaching hour (combining both theory and practice) is 60 minutes counted as 01 standard hour;

c) One practical teaching hour is 60 minutes counted as 01 standard hour.

3. The teaching workload is determined as the number of standard hours each teacher must teach, regulated per academic year.

Thus, the teaching hour norms in vocational education institutions is understood as a unit of time converted from the necessary working hours before, during, and after the teaching hour to complete the task of direct or online teaching.

Based on Article 14 of Decree 88/2022/ND-CP which regulates fines for violations regarding class sizes as follows:

Violation of regulations on class size

Fines for arranging a number of learners exceeding the regulated class size are as follows:

1. A fine from VND 3,000,000 to VND 5,000,000 when exceeding the class size from 30% to under 50%.

2. A fine from VND 5,000,000 to VND 10,000,000 when exceeding the class size from 50% upwards.

Additionally, per Article 3 of Decree 88/2022/ND-CP, which regulates:

Forms of sanctioning, fines, jurisdiction, and principles applied to repeated administrative violations; responsibilities of Ministers, Heads of agencies of ministerial rank, Presidents of People’s Committees at all levels, heads of agencies, units authorized to handle administrative violations in the field of vocational education; suspension of activities as specified in Clause 1 Article 20 of the Law on Vocational Education and Decrees in the field of vocational education

3. Fine levels in vocational education

b) The fine levels for each administrative violation specified in Chapter II of this Decree are the fines for organizations, except for the provisions of Clauses 4 and 5 Article 11, Clause 1 and Clause 2 Article 16, Clauses 1, 2 and 3 Article 21, Point a Clause 3 Article 22, Clause 1 Article 23, Clause 1 Article 27, Point b Clause 1 Article 30, Clause 1 Article 34, Clause 1 Article 35, Clause 1 Article 36 of this Decree are the fines for individuals;

c) For the same administrative violation, the fine level for individuals is 1/2 of that for organizations;

d) Business households and households opening vocational training classes violating the regulations of this Decree shall be fined at the level applied to individuals.

A vocational education institution receiving a number of learners exceeding the class size is fined as follows:

- Exceeding the class size by 30% to under 50%:

+ A fine from VND 3,000,000 to VND 5,000,000 for violating organizations

+ A fine from VND 1,500,000 to VND 2,500,000 for violating individuals

- Exceeding the class size by 50% upwards:

+ A fine from VND 5,000,000 to VND 10,000,000 for violating organizations

+ A fine from VND 1,500,000 to VND 5,000,000 for violating individuals.

Which 03 vocational education institutions can open classes at vocational education levels in Vietnam?

Based on Article 5 of Law on Vocational Education 2014, the 03 vocational education institutions that can open classes at vocational education levels include:

(1) Vocational education centers;

(2) Intermediate schools;

(3) Colleges.

Additionally, currently, there are 03 types of vocational education institutions:

(1) Public vocational education institutions:

These are vocational education institutions owned by the state, invested, and constructed by the state.

(2) Private vocational education institutions:

These are vocational education institutions owned by social organizations, professional and social organizations, private economic organizations, or individuals, invested, and constructed by these organizations.

(3) Foreign-invested vocational education institutions include:

Vocational education institutions with 100% capital from foreign investors; joint venture vocational education institutions between domestic investors and foreign investors.
