What is the position of private lower secondary schools in the national education system of Vietnam?
According to Article 47 of the Education Law 2019, which provides regulations on the type of schools in the national education system, as follows:
Types of Schools in the National Education System
1. Schools in the national education system are organized into the following types:
a) Public schools invested, guaranteed operational conditions, and owned by the State;
b) Community schools invested by local communities, including organizations and individuals at the hamlet, village, subdistrict, phum, sóc, commune, ward, and commune-level towns, to build facilities and ensure operational conditions.
The type of community schools only applies to preschool educational institutions;
c) Private schools invested by domestic or foreign investors and ensuring operational conditions.
Non-profit private schools are those in which investors commit to and fulfill the commitment of non-profit operations, as stated in the establishment decision or decision to convert the type of school; operations are non-profit, no capital withdrawal, no profit sharing; accumulated annual profits belong to unified undivided common ownership to continue investment for the school's development.
Thus, schools in the national education system include three types: Public, Community, and Private.
Additionally, based on Article 2 of the Regulation on the organization and operation of primary schools, lower secondary schools, upper secondary schools, and multi-level schools of the private type, issued together with Circular 40/2021/TT-BGDDT, the position of private lower secondary schools in the national education system is as follows:
- Private general schools are general education institutions in the national education system, invested by domestic or foreign investors, and ensuring operational conditions, permitted to be established and operate by competent State agencies.
- The investment sources for building facilities and operational costs of private general schools are outside the State budget.
- Private general schools have legal entity status, have their own account and seal.

What are the duties and powers of private lower secondary schools of Vietnam?
According to Article 3 of the Regulation on the organization and operation of primary schools, lower secondary schools, upper secondary schools, and multi-level schools of the private type, issued together with Circular 40/2021/TT-BGDDT, the duties and powers of private lower secondary schools are as follows:
[1] Private general schools have the same duties and powers as public general schools as specified in the Charter of primary schools, the Charter of lower secondary schools, upper secondary schools, and multi-level schools (hereinafter collectively referred to as the Charter of general schools) and the regulations in this Regulation.
[2] Private general schools are autonomous and responsible for implementing their planning, development plans; building and developing teaching staff; mobilizing, utilizing, and managing resources to achieve general education goals.
[3] Private general schools are responsible for regular and ad hoc reporting according to the regulations and requirements of competent management agencies.
[4] Private general schools perform other duties and powers as prescribed by law.
Which agency will establish and manage private lower secondary schools of Vietnam?
Based on Article 5 of the Regulation on the organization and operation of primary schools, lower secondary schools, upper secondary schools, and multi-level schools of the private type, issued together with Circular 40/2021/TT-BGDDT, the management hierarchy is regulated as follows:
Management Hierarchy
1. Primary schools, lower secondary schools, and multi-level schools with the highest level being lower secondary, are established and managed by the Chairperson of the District People's Committee.
2. Upper secondary schools and multi-level schools with the highest level being upper secondary are established by the Chairperson of the Provincial People's Committee, managed by the Department of Education and Training. The Department of Education and Training cooperates with the District People's Committee to develop content, coordinate management, and organize related educational activities for multi-level schools with the highest level being upper secondary in their area.
3. The management hierarchy for private general schools invested by foreign investors is in accordance with legal regulations.
Thus, according to the above regulations, private lower secondary schools will be established and managed by the Chairperson of the District People's Committee.
