Recruitment of administrative officials, tenured teachers and employees

  1. Administrative officials, tenured teachers, and employees of private general schools are individuals who are not state officials and public employees; they are recruited by the school and subjected to working policies and implementation of policies in accordance with the Education Law, the general school charter, and other legal provisions.
  1. Tenured teachers are those recruited by the school, signing a labor contract with a term of 36 months or an indefinite term according to the Labor Code; not currently working under a labor contract with a term of 03 months or more with another employer.

According to Article 12 of the Organizational and Operational Regulations for Primary Schools, Secondary Schools, Upper Secondary Schools, and Multi-level Private Schools issued along with Circular 40/2021/TT-BGDDT, it is stipulated as follows:

Requirements pertaining to tenured teacher rate and quota on teachers and employees​

  1. Private general schools must ensure from the first school year the ratio of tenured teachers to the total number of teachers as regulated for corresponding public general schools as follows: primary schools must have at least 90% tenured teachers; lower secondary and upper secondary schools must have at least 40% tenured teachers.
  1. The number of teachers and staff in private general schools must ensure not to be less than the State's regulations on staffing norms for each educational level.

Based on Article 31 of the Charter of Lower Secondary Schools, Upper Secondary Schools, and Multi-level Schools issued along with Circular 32/2020/TT-BGDDT, it stipulates the behavior and conduct of tenured teachers in private upper secondary schools as follows:

- Teachers must not commit the following actions:

+ Insult the honor and dignity; infringe upon the body of students and colleagues.

+ Commit fraud in examinations, recruitment; falsify in testing, assessing the learning and training results of students; skip classes, reduce teaching content arbitrarily.

+ Distort the content of teaching, education; teach the wrong content of knowledge or contrary to the Communist Party of Vietnam and the State of Vietnam's educational viewpoints and guidelines.

+ Force students to take extra classes for money; misuse financial aid or sponsorship for education for compulsory money or in-kind contributions.

+ Smoke, drink alcohol, beer, or use other stimulants while participating in teaching and educational activities.

+ Obstruct or cause difficulties in supporting and serving the teaching and educational activities for students and other tasks.

- Teachers' language and conduct must ensure pedagogical appropriateness, propriety, and educational effectiveness for students.

- Teachers' clothing must be neat, appropriate for pedagogical activities, and comply with the Government of Vietnam's regulations on the dress code for public employees.

Teachers must not violate other prohibited behaviors as stipulated by law. In particular, the prohibited behaviors in educational institutions as stipulated in Article 22 of Education Law 2019 include:

+ Insulting the dignity and honor, infringing upon the body of educators, staff, laborers at educational institutions, and learners.

+ Distorting educational content.

+ Committing fraud in studying, testing, examinations, and recruitment.

+ Smoking; drinking alcohol, beer; causing disturbances to security and order.

+ Forcing students to take extra classes for money.

+ Misusing financial aid or sponsorship for education to compel financial or in-kind contributions.
