Scope of activity for legal disseminators and legal propagandists

1. Legal disseminators from the Ministry, ministerial-level agencies, agencies under the Government of Vietnam, the Central Committee of the Vietnam Fatherland Front, and the central agencies of member organizations of the Front (hereinafter referred to as central legal disseminators) implement law dissemination and education nationwide.

2. Legal disseminators from state agencies, the Vietnam Fatherland Front Committee, and member organizations of the Front in provinces and central-affiliated cities (hereinafter referred to as provincial legal disseminators) implement law dissemination and education within the province, centrally-managed city where they are recognized.

3. Legal disseminators from state agencies, the Vietnam Fatherland Front Committee, and member organizations of the Front in districts, district-level towns, provincial cities, and cities under central-affiliated cities (hereinafter referred to as district legal disseminators) implement law dissemination and education within the district, district-level town, provincial city, or city under a centrally-managed city where they are recognized.

4. Legal propagandists in communes, wards, commune-level towns (hereinafter referred to as legal propagandists) implement law dissemination and education within the commune, ward, or commune-level town where they are recognized.

Thus, according to the above provisions, a legal propagandist is essentially a legal communicator operating at the commune, ward, or commune-level town, conducting law dissemination and education within their recognized locality.

What are procedures for recognizing a legal propagandist in Vietnam?

Based on Article 5 of Circular 10/2016/TT-BTP, the procedures for recognizing a legal propagandist in Vietnam are as follows:

- Based on the requirements for law dissemination, legal education, and the needs and actual conditions at the commune level, the Chairman of the Commune People's Committee decides on the recognition of legal propagandists, ensuring there are enough resources to implement the law dissemination and education work locally.

- Annually in September, the judicial-civil status official chairs and coordinates with the Head of the Front Work Committee, Heads of villages, hamlets, clauses, communities, and other neighborhoods (hereinafter referred to as grassroots areas) and the Heads of political-society organizations at the commune level to publicly announce the standards for legal propagandists as stipulated in Clause 1, Article 37 of the Law on Law Dissemination and Education 2012;

The regulations on recognizing legal propagandists are communicated to organizations, units, and residents at the grassroots level to voluntarily register to become legal propagandists.

- Based on the voluntary registration list to become legal propagandists from grassroots areas, the current official team of the Commune People's Committee, and the need to build a team of legal propagandists, the judicial-civil status official reviews, compiles a list of those meeting the criteria as stipulated in Clause 1, Article 37 of Law on Law Dissemination and Education 2012 for the Chairman of the Commune People's Committee to consider and recognize as legal propagandists.

- Within 5 working days from receiving the list for recognition of legal propagandists from the judicial-civil status official, the Chairman of the Commune People's Committee considers and decides on the recognition of legal propagandists.

- The decision to recognize legal propagandists is sent to the judicial-civil status official, Head of the Front Work Committee, and legal propagandist; it is publicly announced according to the regulations specified at Point b, Clause 2, Article 8 of Circular 10/2016/TT-BTP.

What are 4 cases for termination of legal propagandist duties in Vietnam?

Based on Article 6 of Circular 10/2016/TT-BTP, the 4 cases for terminating the duties of a legal propagandist are as follows:

- Voluntary resignation due to health reasons, family circumstances, or other legitimate reasons;

- Engaging in one of the prohibited acts as prescribed in Article 9 of the Law on Law Dissemination and Education;

- Being sentenced by a court and the sentence has come into legal effect;

- Losing civil act capacity or having difficulties in cognition, behavior control, or limited civil act capacity as prescribed by the Civil Code.
