Is Christmas in 2024 a holiday for contract teachers in Vietnam?
Based on the provisions in Article 112 of the Labor Code 2019 regarding public holidays:
Public Holidays
1. Employees are entitled to take leave with full pay on the following holidays:
a) New Year's Day: 01 day (January 1, Gregorian calendar);
b) Lunar New Year: 05 days;
c) Victory Day: 01 day (April 30, Gregorian calendar);
d) International Labor Day: 01 day (May 1, Gregorian calendar);
e) National Day: 02 days (September 2, Gregorian calendar and 01 day contiguous before or after);
f) Hung Kings’ Commemoration Day: 01 day (March 10, Lunar calendar).
2. Foreign employees working in Vietnam, in addition to the holidays specified in Clause 1 of this Article, are entitled to an additional traditional New Year day and a national day of their country.
3. Every year, based on actual conditions, the Prime Minister of the Government of Vietnam decides on the specific holiday schedule as prescribed at Point b and Point e, Clause 1 of this Article.
Based on Article 113 of the Labor Code 2019 regarding annual leave:
Annual Leave
1. Employees who work for 12 months for an employer are entitled to annual leave with full pay as per their labor contract as follows:
a) 12 working days for those doing normal conditions work;
b) 14 working days for minors, disabled workers, those doing heavy, hazardous, or dangerous jobs;
c) 16 working days for those doing particularly heavy, hazardous, or dangerous jobs.
2. Employees working for less than 12 months for an employer, will have their annual leave days calculated proportionately based on their working months.
3. In case of resignation or job loss where annual leave is not taken or not fully taken, the employer shall pay wages for the unused leave days.
4. Employers are responsible for setting the annual leave schedule after consulting with employees and must inform employees in advance. Employees may agree with their employers to take annual leave in parts or accumulate it for up to 3 years in one go.
5. During annual leave when the payday has not yet arrived, employees are entitled to a salary advance as prescribed in Clause 3, Article 101 of this Code.
6. During annual leave, if employees travel by road, rail, or waterway and the travel days exceed 02 days in total, starting from the 3rd day, additional travel time beyond the annual leave is granted, only for one leave in a year.
7. The Government of Vietnam prescribes the details of this Article.
Thus, the Christmas holiday in 2024 is not included in the annual leave schedule for contract teachers. However, if Christmas falls on a weekend, contract teachers will have the day off.

- Deputy head of the specialized division is reduced by 1 period/week.
- Teachers concurrently heading a functional department at a pre-university school are reduced by 3 periods/week;
Teachers concurrently serving as deputy heads of a functional department at a pre-university school are reduced by 1 period/week.
Therefore, depending on the position held by the teacher, the reduction in teaching periods will vary.
