Pursuant to Article 12 of the Regulations on the organization and operation of primary schools, lower secondary schools, upper secondary schools, and multi-level schools of the private type, issued together with Circular 40/2021/TT-BGDDT, the requirements pertaining to tenured teacher rate and quota on teachers and employees are as follows:
Requirements pertaining to tenured teacher rate and quota on teachers and employees
1. Private general education schools must ensure from the first school year that the percentage of tenured teachers compared to the total number of teachers corresponds to the regulations for public general education schools at the respective educational level as follows: primary level must have at least 90% tenured teachers; lower secondary and upper secondary levels must have at least 40% tenured teachers.
2. The number of teachers and staff of private general education schools must ensure not less than the State regulations on staffing norms for teachers and staff for each educational level.
Private general education schools must ensure from the first school year that the percentage of tenured teachers compared to the total number of teachers corresponds to the regulations for public general education schools at the respective educational level: lower secondary and upper secondary levels must have at least 40% tenured teachers.
Thus, private lower secondary schools must ensure that at least 40% of teachers are tenured teachers.

Pursuant to Article 13 of the Regulations on the organization and operation of primary schools, lower secondary schools, upper secondary schools, and multi-level schools of the private type, issued together with Circular 40/2021/TT-BGDDT, regulations on the recruitment of management staff, tenured teachers, and staff are as follows:
Recruitment of management staff, tenured teachers, and staff
1. Management staff, tenured teachers, and staff of private general education schools are those who are not state officials and public employees; recruited by the school and subject to the working policies and implementation of policies in accordance with the Education Law, the Charter of general education schools, and other legal regulations.
2. tenured teachers are teachers recruited by the school, signing a labor contract with a duration of 36 months or an indefinite-term contract in accordance with the Labor Code; not working under any labor contract with a duration of 03 months or more with any other employer.
Thus, according to the above regulation, tenured teachers in private lower secondary schools are teachers who are recruited into private lower secondary schools.
Simultaneously, tenured teachers in private lower secondary schools must sign a labor contract with a duration of 36 months or an indefinite-term contract in accordance with Labor Code 2019; and not working under any labor contract with a duration of 03 months or more with any other employer.

Pursuant to Article 11 of the Regulations on the organization and operation of primary schools, lower secondary schools, upper secondary schools, and multi-level schools of the private type, issued together with Circular 40/2021/TT-BGDDT, the responsibilities of teachers, management staff, and staff are as follows:

1. Teachers, management staff, and staff in private general education schools must meet the standard levels of training, professional standards as prescribed in the Education Law, the Charter of general education schools, and other legal regulations.
2. Teachers, management staff, and staff shall fully perform the duties stated in the labor contract signed with the school; have the duties and rights according to the provisions of the Education Law, the Charter of general education schools, and other legal regulations.

The responsibilities of teachers are implemented according to the regulations in the Charter of primary schools, the Charter of lower secondary schools, upper secondary schools, and multi-level schools; Regulations on the organization and operation of boarding general education schools, semi-boarding general education schools, specialized schools, and university preparatory schools.
Referring to Article 27 of the Charter of lower secondary schools, upper secondary schools, and multi-level schools (issued together with Circular 32/2020/TT-BGDDT), tenured teachers in private lower secondary schools will have (8) responsibilities including:
[1] Participate in professional development and training.
[2] Perform other tasks as prescribed by law.
[3] Participate in the local lower secondary education universalization effort.
[4] Engage in learning and practice to improve health, political qualities, professional skills, and innovative teaching and education methods.
[5] Coordinate with the Ho Chi Minh Young Pioneer Organization, Ho Chi Minh Communist Youth Union, Vietnam Youth Union, students' families, and related social organizations to organize educational activities.
[6] Fulfill civic duties, comply with legal and educational regulations, and execute decisions from the principal; perform tasks assigned by the principal, subject to inspection, and assessment by the principal and education management levels.
[7] Uphold moral standards, high responsibility, maintain the quality, honor, and prestige of teachers; be exemplary for students; love, treat fairly, and respect students' personalities; protect the legitimate rights and interests of students; and unite and support colleagues.
[8] Organize teaching and educational activities according to the school's educational plan and the specialized team’s educational plan; manage students in educational activities organized by the school; participate in professional activities; and be responsible for the quality and efficiency of education.
