Pursuant to Clause 1, Article 2 of Circular 20/2023/TT-BGDDT, the principles for determining job positions and staffing levels in public secondary schools are as follows:

1. The determination of job positions and staffing levels in public secondary schools must follow the regulations stipulated in Article 3 of Decree No. 106/2020/ND-CP dated September 10, 2020, of the Government of Vietnam, regarding job positions and staffing levels in public service providers (hereinafter referred to as Decree No. 106/2020/ND-CP)

Therefore, the determination of job positions and staffing levels in public secondary schools follows the regulations stipulated in Article 3 of Decree 106/2020/ND-CP, following these five principles:

[1] Strictly adhere to the policies of the Communist Party and the laws on job positions, staffing levels, and workforce reduction in public service providers.

[2] Align with the functions, duties, powers, and organizational structure of public service providers.

[3] Ensure scientific, objective, public, transparent, and effective principles to improve the quality of public employees and labor in public service providers.

[4] Ensure that each employee is assigned enough workload to work within the prescribed labor time. Job positions without enough workload for one person's working time must be assigned on a concurrent basis.

[5] Ensure rational structure, in which the number of employees in specialized and general professional job positions accounts for at least 65% of the total employees in public service providers.

What are the regulations on limits on number of employees in public lower secondary schools in Vietnam?

According to Clause 2, Article 2 of Circular 20/2023/TT-BGDDT, limits on number of employees in public secondary schools must ensure the following:

1) Ensure the required number of staff as prescribed in this Circular to perform teaching duties for all subjects and educational activities in the general education program issued by the Ministry of Education and Training, and to carry out common professional tasks, support, and service tasks of the public secondary school.

2) Job positions without enough workload for one employee's working time must be assigned on a concurrent basis.

Job positions without assigned staffing will be held under labor contracts or concurrent positions.

Employees assigned concurrent duties must be trained and cultivated to meet the professional and operational capacity of the concurrent job position.

3) The number of teachers in public secondary schools includes teachers recruited as public employees and contract teachers.

Public secondary schools with a number of public employee teachers below the maximum quota as stipulated by this Circular (either due to insufficient assigned staffing or unfilled recruitment) must determine the number of contracted teachers based on the maximum quota stipulated in Circular 20/2023/TT-BGDDT following the regulations in Decree 111/2022/ND-CP.

4) The number of employees according to the quota and job positions stipulated in this Circular must be determined based on the class size of each secondary school.

5) For schools with multiple educational levels:

The number of vice-principals must comply with the regulations on the number of deputy positions in Decree 120/2020/ND-CP.

The number of teachers must comply with the regulations in Circular 20/2023/TT-BGDDT for each educational level;

The list of job positions, the staffing quota of professional titles (excluding teachers, teachers responsible for the Ho Chi Minh Young Pioneer Organization, and supporting staff for students with disabilities), common professional job positions, and supporting and service positions in schools with multiple educational levels must comply with the regulations for the highest educational level.

The number of classes or students used as a basis for determining the number of employees according to the regulations for the highest educational level is the total number of classes or students of all educational levels.

Job positions supporting the education of students with disabilities in schools with multiple educational levels that cater to inclusive education students: Schools with fewer than 20 inclusive education students can allocate 1 person; schools with 20 inclusive education students or more can allocate up to 2 persons.

Each school can allocate 1 teacher (primary or secondary school teacher) as the teacher in charge of the Ho Chi Minh Young Pioneer Organization.

How to classify job positions in public lower secondary schools in Vietnam?

According to Article 5 of Decree 106/2020/ND-CP, job positions in public secondary schools are categorized as follows:

Categorization by workload

- Job positions held by one person

.- Job positions held by multiple persons.

- Concurrent job positions.

Categorization by the nature and content of the work

- Leadership and management positions.

- Specialized professional titles job positions.

- General professional titles job positions (administration, synthesis, office management, personnel organization, financial planning, and job positions without specialized professional titles in public service providers).

- Supporting and service job positions.

Thus, job positions in public secondary schools are categorized into two types: {1} Categorization by workload; {2} Categorization by the nature and content of the work.
