On August 22, 2024, the Ministry of Education and Training published the Draft Circular on Regulations for extra class (the Draft) on the Ministry's electronic information portal to solicit public comments.

**** The Draft explicitly allows teachers to offer extra class outside of school premises.
Teachers offering extra class outside of school must adhere to the following points as specified in the Draft:
Teachers (including Vice Principals or deputies of the institution head) currently employed and salaried by the payroll fund of a public secondary education institution or continuous education institution who participate in extra class outside of school must meet the following requirements:
- Report to the Principal about the subject, location, schedule of tutoring, and commit to the Principal to complete assigned duties without violating extra class principles.
- If a teacher’s extra class class includes students they are currently teaching in school, they must report and list these students (full names and classes in school) to the Principal and assure not to coerce any student into taking extra lessons.
Moreover, any Principal who engages in extra class outside of school must report and obtain consent from the Head of the District Education and Training Office (for middle schools) or the Director of the Department of Education and Training (for high schools).

Responsibilities of Organizations and Individuals Providing extra class Outside of School Premises According to Current Regulations in Vietnam
According to Article 20 of the Regulations on extra class and Extra Classes promulgated with Circular 17/2012/TT-BGDDT, the responsibilities of organizations and individuals providing extra class outside school premises are as follows:
- Comply with the regulations on extra class and extra classes by the Ministry of Education and Training, provincial People’s Committee rules, and other relevant legal provisions.
- Manage and ensure the rights of students and teachers participating in extra class. In the event of temporary suspension or termination of extra class, the licensing authority must be informed, and public notice must be given to the students at least 30 days in advance. Refund the fees collected from students corresponding to the unfulfilled tutoring sessions and fully settle payments with tutors and related organizations or individuals.
- Manage, preserve, and present for inspection the extra class records, including the application for organizing extra class activities, the list of tutors, the list of students, the tutoring schedule, student application forms, and financial records as per current regulations.
- Subject to inspection and supervision by the government and educational management authorities at all levels in compliance with extra class regulations; submit periodic reports to the management authority.
Current Regulations on Collecting and Managing extra class Fees Outside of School in Vietnam
As stipulated in Article 7 of the Regulations on extra class promulgated with Circular 17/2012/TT-BGDDT:
Collecting and Managing extra class Fees
1. For extra class within the school:
a) Fees collected from extra class are used to pay the teachers directly involved in tutoring, manage the tutoring activities of the school, cover costs of electricity, water, and maintenance of facilities used for tutoring;
b) The fee rate is agreed upon between parents and the school;
c) The school organizes the collection, expenditure, and public accounting of the tutoring fees via the school’s financial department; private tutors are not directly involved in collecting or spending tutoring fees.
2. For extra class outside of school:
a) The fee rate is agreed upon between parents and the organization or individual offering extra class services.
b) The organization or individual providing extra class complies with the current financial management regulations regarding tutoring fees.
Thus, the current regulations on collecting and managing extra class fees for tutoring outside of school are as follows:
(1) The fee rate is agreed upon between parents and the organization or individual providing extra class.
