Based on Article 37 of Decree 125/2024/ND-CP, the conditions for establishing a public community learning center are specified as follows:

- There must be a location, classrooms, office rooms, and equipment that meet the educational activities' requirements at the center.

- There must be an educational program, study plans, and learning materials in accordance with the educational activities at the center as regulated by the Ministry of Education and Training.

- There must be administrative staff and teachers meeting the requirements for educational activities at the center as regulated by the Ministry of Education and Training.

What are the procedures for establishing a public community learning center in Vietnam?

According to Article 38 of Decree 125/2024/ND-CP, the procedures for establishing a public community learning center in Vietnam are as follows:

(1) Application dossier includes:

- A proposal for the establishment or permission to establish a community learning center (according to Form No. 01 Annex 1 attached to Decree 125/2024/ND-CP);

- A copy of the legal documents proving the right to use land, home ownership, or lease contract of the center's location;

(2) Procedures:

Step 1: The communal People's Committee (if a public center is to be established) submits 01 set of the application dossier in (1) via the online public service portal or by postal service or directly to the district People's Committee

Step 2: Within 05 working days from the date of receiving the complete dossier, if the dossier is invalid, the district People's Committee or the Department of Education and Training shall notify in writing the contents that need to be amended and supplemented to the agency, organization, or individual requesting the establishment or permission to establish the center. If the dossier is valid, the district People's Committee or Department of Education and Training organizes the appraisal of the dossier and an on-site appraisal of the conditions for establishing the center, preparing an appraisal report to evaluate compliance with the provisions of Article 37 of Decree 125/2024/ND-CP within 10 days;

Step 3: Within 05 working days from the date of the appraisal report, if all conditions are met, the Department of Education and Training submits to the Chairman of the district People's Committee for a decision to establish the public community learning center. If conditions are not met, a written notification is sent to the agency, organization, or individual requesting the establishment, clearly stating the reasons.

The decision to establish or permit the establishment of a community learning center (according to Form No. 10 Annex 1 attached to Decree 125/2024/ND-CP) is publicly announced through mass media.

Note: The Chairman of the district People's Committee decides on the establishment of a public community learning center; the Head of the Department of Education and Training decides on permitting the establishment of a private community learning center.

When is the activity of a public community learning center suspended in Vietnam?

According to Clause 1, Article 39 of Decree 125/2024/ND-CP, the activities of community learning centers are suspended in the following cases:

- There is fraudulent behavior to be established or allowed to establish the center;

- Failing to ensure any condition stipulated in Article 37 of Decree 125/2024/ND-CP;

- Not initiating educational activities within 01 year from the date of decision to establish or allow the establishment of the center;

- Violating educational law resulting in administrative penalties at a level requiring suspension;

- Other cases as prescribed by law.

What are procedures for suspending a public community learning center in Vietnam?

Step 1: When violations as stated in the above section are detected at a community learning center, the Department of Education and Training conducts an inspection to assess the actual status of the center, drafts an inspection record, and notifies the center of the violations;

Step 2: Within 10 days from the date of the notification of the violation, based on the extent of the violation, the Department of Education and Training submits a proposal to the Chairman of the district People's Committee for a decision to suspend the activities of the public community learning center.

The decision to suspend the activities of a community learning center (according to Form No. 10 Annex I attached to Decree 125/2024/ND-CP) is publicly announced through mass media;

Step 3: During the suspension period, if the cause leading to the suspension is rectified, the center reports in writing with evidence to the Chairman of the district People's Committee or the Head of the Department of Education and Training.

Within 07 working days from the date of receipt of the center's notification, the Chairman of the district People's Committee or the Head of the Department of Education and Training decides to allow the community learning center to resume activities and publicly announces this through mass media.
