- Having a site to build the necessary facilities and equipment according to the following regulations:

+ Sufficient classrooms, laboratories, libraries, and vocational practice rooms;

+ Teaching equipment and study materials required to implement continuing education programs.

What are the procedures for establishing a continuing education center in Vietnam?

Pursuant to Article 38 of Decree 46/2017/ND-CP, the procedures for establishing a continuing education center are as follows:

* Authority to decide establishment: The Chairman of the provincial People's Committee decides to establish a provincial-level continuing education center.

* Establishment dossier includes:

- Official Dispatch requesting the establishment of the provincial-level continuing education center by the Department of Education and Training;

- Scheme for establishing the continuing education center clearly stating the need for the center's operation; the direction of the center's activities; the conditions of facilities and management staff, teachers as prescribed in Article 37 of Decree 46/2017/ND-CP;

- Curriculum vitae of the proposed Director of the center.

* Implementation procedures:

Step 1: The Department of Education and Training submits directly or by post 01 dossier to the Department of Home Affairs for appraisal;

Step 2: Within 10 working days from the date of receiving a valid dossier, the Department of Home Affairs organizes the appraisal and transfers the dossier to the provincial People’s Committee for verification;

Step 3: Within 05 working days from the date of receiving a valid dossier, the Chairman of the provincial People's Committee decides to establish the provincial-level continuing education center. If not decided, the Department of Education and Training will be notified in writing, stating the reasons.

What are regulations on the suspension of educational activities for continuing education centers in Vietnam?

Pursuant to Article 40 of Decree 46/2017/ND-CP (annulled by Article 2 of Decree 135/2018/ND-CP), the suspension of educational activities for continuing education centers is regulated as follows:

* The suspension of educational activities in continuing education centers is carried out in the following cases:

- Violations of the law on administrative sanctions in the education sector requiring suspension;

- Objective reasons preventing the continuing education center from ensuring its educational activities.

* Authority to decide suspension: The Chairman of the provincial People's Committee decides to suspend educational activities of the continuing education center.

* Implementation procedures:

- The Department of Education and Training issues an official dispatch requesting the Department of Home Affairs to establish an inspection team, organize inspections, make an inspection report evaluating the actual situation of the continuing education center; transfer the inspection dossier to the office of the provincial People's Committee for verification and submission to the Chairman of the provincial People's Committee for the decision to suspend the activities of the continuing education center;

- The decision to suspend educational activities of the continuing education center must clearly specify the reasons for suspension, the duration of suspension; measures to ensure the lawful rights and interests of learners, teachers, management staff, and employees and must be publicly announced in the mass media;

- After the suspension period, if the continuing education center rectifies the causes leading to the suspension, the provincial People's Committee issues a decision allowing the continuing education center to resume educational activities and must publicly announce this in the mass media. If the center is not permitted to resume educational activities, a written notice stating the reasons and solutions must be sent to the Department of Education and Training or organization, individual concerned;

- The dossier for requesting re-operation includes: A proposal for re-operation;

- The procedure for allowing the continuing education center to resume educational activities is carried out in accordance with Clause 3, Article 38 of Decree 46/2017/ND-CP.

When is a continuing education center in Vietnam dissolved?

Pursuant to Clause 1, Article 41 of Decree 46/2017/ND-CP (annulled by Article 2 of Decree 135/2018/ND-CP), a continuing education center is dissolved in the following cases:

- Serious violations of regulations on management, organization, and operation of the center;

- Expiry of the suspension period stated in the suspension decision without rectifying the cause leading to the suspension.
