Under Article 3 of Circular 02/2022/TT-BGDDT, higher education institutions in Vietnam must meet the general conditions when offering a new undergraduate, master's, or doctoral programs, including:

Condition (1) Meet the requirements for the intended training program and level.

Condition (2) Fulfill requirements regarding lectures.

Condition (3) Meet the physical infrastructure requirements.

Condition (4) The proposed training program must be developed, appraised, and issued in accordance with the regulations of the Ministry of Education and Training, meet the training program standards for the field, group of disciplines, and training program, and be aligned with the Vietnam National Qualifications Framework.

Condition (5) The training institution must have an academic unit at the faculty level or equivalent to manage specialized activities, faculty members, learners, and other management tasks related to the proposed training program.

Condition (6) The training institution must meet the minimum requirements and conditions as prescribed by the current regulations of the Ministry of Education and Training to be ready to convert to online teaching while ensuring training quality as prescribed.

Condition (7) The school council must have a resolution approving the policy to offer a new training program at the institution.

Where the institution does not have a school council, there must be written approval of the policy to offer a new training program from the supervisory authority.

Under Article 4 of Circular 02/2022/TT-BGDDT, the requirements regarding teachers for offering a new undergraduate program in Vietnam are as follows:

- Having at least one Ph.D. in a relevant field as a tenured lecturer other than tenured lecturers is the condition for offering other undergraduate programs (in cases where the proposed training program is a combination of disciplines from different groups, or a multidisciplinary training program arranged in several groups, each combined discipline must have at least one Ph.D. in a suitable field as a tenured lecturer), with at least three years of experience in educational management or undergraduate teaching, responsible for leading the development and implementation of the training program.

- There are at least five Ph.D. holders who are tenured lecturers with relevant expertise to lead the teaching of the program (including the suitable Ph.D. as stipulated in clause 1 of Article 4 of Circular 02/2022/TT-BGDDT), ensuring each part of the training program has lecturers with relevant expertise leading the instruction.

For programs training teachers in Vietnamese ethnic minority languages, the Vietnamese Language, Literature and Culture discipline, Foreign Language, Literature and Culture studies, Sports; and Arts (as stipulated in the Statistical List of Training Disciplines), there must be at least three Ph.D. holders as tenured lecturers with appropriate expertise.

- There is a team of lecturers to implement the training program (as stipulated in point a, clause 2 of Article 3 of Circular 02/2022/TT-BGDDT) for the first two academic years of the program, and each course component must have at least two lecturers with suitable expertise. The lecturer-student ratio must comply with the prescribed standards.

There must be recruitment and development plans for the faculty team for subsequent years of the course so that from the third academic year, at the latest one year before a new academic year begins, the full quantity and quality of faculty for each academic year of the course must be ensured.

For training programs in Health, Law, Education and Pedagogy (as listed in the Statistical List of Training Disciplines), all conditions regarding faculty for the entire course must be met at the time of submission for offering the program.

- For Health-related training programs, conditions set forth in clauses 1, 2, 3 of Article 4 of Circular 02/2022/TT-BGDDT must be met, including specific conditions regarding faculty laboratories for each discipline as stipulated in Table 1, Appendix 2 issued together with the Circular 02/2022/TT-BGDDT. For those in the Law sector, conditions as per clauses 1, 2, 3 of Article 4 and at least three Ph.D. holders in the Law field must be met.

- The infrastructure conditions as outlined in point b, clause 3 of Article 3 of Circular 02/2022/TT-BGDDT must be ensured for the first two academic years of the program. Plans for infrastructure investment and equipment procurement for subsequent years must be prepared so that from the third academic year, at the latest one year before a new academic year's start, full infrastructure conditions as required by the training program for each academic year must be satisfied.

For programs in Health, Law, Education, and Pedagogy, all infrastructure conditions (as per point b, clause 3 of Article 3 of Circular 02/2022/TT-BGDDT) for the entire course must be met at the time of submission for offering the program.

- For disciplines within the Health sector, conditions under clause 5, Article 4 must be satisfied. Specific conditions regarding laboratories and practice facilities for each training program must be met as specified in Table 2, Appendix 2 issued together with Circular 02/2022/TT-BGDDT. For those in the Law sector, relevant provisions must be adhered to under clause 5, Article 4, along with having mock trial rooms and legal practice centers.
