What are regulations on management of Fulbright Unveristy Vietnam when it operates in Vietnam?
According to Article 1 of Decision 819/QD-TTg in 2016 regarding the establishment of Fulbright University Vietnam issued by the Prime Minister of the Government of Vietnam:
FUV University is the acronym for Fulbright University Vietnam.
Additionally, according to Article 2 of Decision 819/QD-TTg in 2016:
Fulbright University Vietnam is a higher education institution with 100% foreign investor capital, having legal status, a seal, and its own account, operating on a non-profit basis; headquartered in Ho Chi Minh City; under the State management for education and training of the Ministry of Education and Training; and under the State management for territory of the People's Committee of Ho Chi Minh City.
Fulbright University Vietnam is a university with 100% foreign investment.
Thus, according to the provisions, when operating in Vietnam, Fulbright University must comply with the State management for education and training by the Ministry of Education and Training, and the State management for territory by the People's Committee of Ho Chi Minh City.

What are regulations on the number of Vietnamese students of Fulbright University Vietnam (FUV)?
FUV was established according to Vietnamese law (Decision 819/QD-TTg in 2016 and Decree 86/2018/ND-CP)
As mentioned above, FUV is subject to the State management for education and training by the Ministry of Education and Training, and the State management for territory by the People's Committee of Ho Chi Minh City.
Therefore, the admission of Vietnamese students will also comply with Article 39 of Decree 86/2018/ND-CP as follows:
- FUV is allowed to admit Vietnamese students into foreign educational programs. The number of Vietnamese students studying foreign educational programs should be less than 50% of the total number of students studying foreign educational programs at the educational institution.
- Vietnamese students studying foreign educational programs must learn mandatory contents according to Clause 3, Article 37 of Decree 86/2018/ND-CP. To be specific:
+ The educational program implemented at the foreign-invested educational institution must reflect educational goals, not include content detrimental to national defense, national security, public interest; not propagate religion, distort history; not adversely impact Vietnamese culture, ethics, traditions, and customs; and must ensure conditions for the continuity between education levels and training degrees.
+ A foreign-invested educational institution is allowed to organize teaching:
++ Vietnamese educational programs according to Vietnamese legal regulations;
++ Foreign preschool education programs, foreign general education programs for educational institutions regulated in Clauses 2 and 3, Article 28 of Decree 86/2018/ND-CP;
++ Short-term foreign training programs; undergraduate, master's, and doctoral training programs in the framework of foreign training cooperation.
++ The Minister of Education and Training regulates mandatory education and training contents for Vietnamese citizens studying in preschools, general education institutions, higher education institutions, and branches of higher education institutions with foreign investments.
Therefore, FUV is allowed to admit Vietnamese students into foreign educational programs.
The number of Vietnamese students studying foreign educational programs must be less than 50% of the total number of students studying foreign educational programs at the educational institution.
What are the rights and obligations of FUV?
FUV was established according to Vietnamese law (Decision 819/QD-TTg in 2016 and Decree 86/2018/ND-CP) as a wholly foreign-invested university.
Therefore, the rights and obligations of FUV are similar to those of foreign-invested higher education institutions and must comply with the provisions of Article 32 of Decree 86/2018/ND-CP as follows:
- The rights and legal interests are protected in accordance with Vietnamese law and international treaties to which Vietnam is a member.
- Subject to the territorial administrative management of the provincial People's Committee; operating and obeying the state management according to the provisions of Vietnamese law.
- Publicly implement commitments on educational quality, conditions ensuring educational quality, and financial revenue and expenditure. Responsible for reimbursing learners for the fees they have paid in case of providing training programs that do not meet the committed educational quality.
- Ensure the legitimate rights and interests of learners, staff, lecturers, teachers, and workers in case of terminating or being forced to terminate operations ahead of time.
- Facilitate the activities of political organizations, political-social organizations established and operating in accordance with Vietnamese law at the foreign-invested educational institution.
- By November 30 every year, report directly to the state management agency on the comprehensive development of the institution and provide full explanations when required by the state management agency. The report includes main contents: Implementation of the decision allowing operation, organizational structure, teachers, admissions, organization of teaching and learning, learners’ results, graduate number, graduation rate, issued diplomas, financial report, difficulties, advantages during the implementation, proposals, recommendations. Reports are made both online and in writing.
- Other rights and obligations in accordance with Vietnamese law.
