Based on Article 4 of Decree 125/2024/ND-CP, the procedures for establishing a preschool from November 20, 2024, are stipulated as follows:

Step 1: The People's Committee of the commune, ward, or commune-level town (hereinafter collectively referred to as the commune-level People's Committee) (if proposing to establish a public preschool); organizations or individuals (if proposing to establish a private or semi-public preschool) submit one set of documents via the online public service portal, postal service, or directly to the district-level People's Committee.

Step 2: Within 5 working days from the date of receiving the complete dossier, if the dossier is not valid, the district-level People's Committee shall notify in writing the contents that need to be amended to the agency, organization, or individual proposing the establishment or permission to establish a preschool.

If the dossier is valid, the district-level People's Committee directs the Department of Education and Training to conduct an appraisal of the conditions for establishing or permitting the establishment of a preschool.

Step 3: Within 15 days from the date of receiving the directive from the district-level People's Committee, the Department of Education and Training shall preside and cooperate with relevant specialized departments to appraise the conditions for establishing or permitting the establishment of a preschool based on the dossier; prepare an appraisal report to evaluate compliance with regulations; submit it to the Chairman of the district-level People's Committee for review and decision.

Step 4: Within 5 working days from the date of receiving the appraisal report from the Department of Education and Training, if the conditions are met, the Chairman of the district-level People's Committee shall decide to establish or permit the establishment of a preschool.

If the conditions are not met, a written notice specifying the reasons is sent to the agency, organization, or individual proposing the establishment or permission to establish a preschool.

The decision to establish or permit the establishment of a preschool is publicly announced in the media.

What are cases in which a preschool in Vietnam is suspended from educational activities?

Based on Clause 1, Article 7 of Decree 125/2024/ND-CP, a preschool can be suspended from educational activities in one of the following cases:

- Engaging in fraudulent acts to gain permission for educational activities;

- The person granting permission for educational activities lacks appropriate authority;

- Failing to commence educational activities within 1 year from the date of permission;

- Violating legal regulations on education warranting administrative sanctions leading to suspension of educational activities;

c) For private preschools, a legal document confirming the investment amount managed by the school ensuring legality and suitability with the projected scale at the time of registration for educational activities;

d) Regulations on the organization and operation of the school covering the following main contents: Legal position, duties, and rights of the school; organization and management of the school; organization of care, nurturing, and education of children; duties and rights of the management team, teachers, staff, workers, and children; financial resources and assets of the school; other issues related to the organization and operation of the school.

Thus, the dossier for allowing a preschool to operate educational activities includes:

- A request for allowing the preschool to operate educational activities;

- Copies of legal documents proving land use rights, house ownership rights, or lease agreements for preschool premises with a minimum term of 5 years;
