What are 9 prohibited acts during the enforcement of Martial Law in Vietnam?

Martial law is a special, temporary measure applied when the security and order situation in a certain area becomes too severe, to the extent that local authorities can no longer control the situation. At this time, the military is assigned the task of managing and maintaining order in that area.

According to current regulations in Vietnam, based on Clauses 1 and 2, Article 21 of the National Defense Law 2018, martial law is stipulated as follows:

Martial Law is a special temporary state management measure executed by the military.

- Special measures and the 9 prohibited acts when Martial Law is enforced include:

[1] Banning or restricting movement of people and vehicles; suspending or limiting activities in public places;

[2] Banning protests, strikes, market walkouts, school walkouts, mass gatherings;

[3] Arresting or coercing individuals or organizations with activities harming national defense and security to leave or banning them from leaving their residence or a specific area;

[4] Mobilizing people and means of agencies, organizations, individuals;

[5] Special management of weapons, explosives, supporting tools, flammable substances, toxic substances, radioactive substances; strictly controlling information infrastructure, communication facilities, press activities, publishing, printing facilities, photocopying, collecting, and using information.

[6] All activities in a locality under martial law must comply with martial law orders and special measures.

[7] The trial of crimes occurring in a locality during the enforcement of martial law orders shall be in accordance with the provisions of the Criminal Procedure Code 2015.

[8] When the political security situation, order, and social safety in the locality under martial law stabilize, the President shall issue an order to abolish the martial law order at the proposal of the Government of Vietnam.

[9] The Government of Vietnam regulates the duties and powers of the commanders of military units, agencies, organizations, and localities related to the execution of martial law orders, the abolishment of martial law orders.

Based on the provisions of Article 11 of the Law on Legal Dissemination and Education 2012, the 8 current forms of legal dissemination and education include:

[1] Press conferences, press releases.

[2] Direct legal dissemination; consultation, guidance to learn about the law; provision of legal information and documents.

[3] Through mass media, loudspeakers, the internet, panels, posters, propaganda images; publishing in the Official Gazette; posting legal information on electronic information pages; posting at headquarters, bulletin boards of agencies, organizations, or residential areas.

[4] Organizing legal knowledge competitions.

[5] Through the handling of administrative violations, citizen reception activities, the resolution of complaints and denunciations by citizens, and other activities of the state apparatus; through legal aid activities, mediation at the grassroots level.

[6] Integrating in cultural, art, activities of political organizations and associations, clubs, legal bookcases, and other cultural institutions at the grassroots.

[7] Through legal education programs in educational institutions of the national education system.

[8] Other forms of legal dissemination and education suitable to specific subjects that agencies, organizations, or individuals with authority may apply to ensure effective legal dissemination and education.

Article 2 of the Law on Legal Dissemination and Education 2012 states as follows:

Right to Information about the Law and the Responsibility to Learn and Study the Law of Citizens

  1. Citizens have the right to information about the law and are responsible for actively learning and studying the law.
  1. The State ensures and creates conditions for citizens to exercise their right to information about the law.

According to above regulations, besides the dissemination from teachers and local authorities, students themselves must actively learn about legal regulations.

What is the necessary content when disseminating legal education to everyone in Vietnam?

According to Article 10 of the Law on Legal Dissemination and Education 2012:

- Provisions of the Constitution and legal normative documents, especially the provisions of civil, criminal, administrative, marriage and family, gender equality, land, construction, environmental protection, labor, education, healthcare, national defense, security, traffic laws, the basic rights and obligations of citizens, rights and responsibilities of state agencies, officials, newly issued legal normative documents.

- International treaties to which the Socialist Republic of Vietnam is a member, international agreements.

- Awareness of respecting and complying with the law; awareness of protecting the law; benefits of complying with the law; examples of good people and good deeds in complying with the law.
