Based on the provisions of Article 21 of the Law on Physical Training and Sports 2006 (amended and supplemented by points a and b, clause 6, Article 1 of the Amended Law on Physical Training and Sports 2018) regarding the responsibilities of the State for physical education and sports in schools:

Responsibility 1. The State has policies to allocate land and invest in building facilities for physical education and sports activities in schools, ensuring there are enough physical education teachers and lecturers for all education levels and educational training; prioritize the development of swimming, traditional martial arts, and national sports.

Responsibility 2. The Minister of Education and Training and the Minister of Labor, Invalids and Social Affairs, within their responsibilities and powers, have the following responsibilities:

- Prescribe standards for facilities, physical education, and sports equipment for physical education activities at all education levels and training degrees;

- Specify the number, professional standards of physical education and sports teachers and lecturers for all education levels and training degrees;

- Develop and promulgate the physical education curriculum, training and fostering physical education and sports teachers and lecturers, and guide extracurricular sports activities in schools;

- Issue standards for evaluating and grading the physical fitness of students.

Responsibility 3. Ministries, ministerial-level agencies, and agencies under the Government of Vietnam are responsible for directing and organizing the construction of facilities, arranging physical education and sports lecturers and teachers for schools under their management.

Responsibility 4. Provincial People's Committees, centrally-run cities (hereinafter referred to as provincial-level People's Committees) have the following responsibilities:

- Plan land, construct facilities, multifunctional gyms, ensure sports equipment, implement staff norms of physical education and sports teachers and lecturers for public schools within the locality;

- Implement preferential land policies in accordance with the law for private and people-founded schools to enable these schools to build facilities serving physical education and sports in schools.

Responsibility 5. Ministries, ministerial-level agencies, provincial-level People's Committees specify the responsibility for coordination among the public sports facilities they manage with educational facilities to use sports works for serving physical education and sports activities in schools.

Additionally, contents are also guided by Article 7 of the Decree 112/2007/ND-CP as follows:

- The Ministry of Education and Training cooperates with the Sports Committee to develop the curriculum and national standards for physical education and sports in schools and other educational institutions within the national education system appropriate to each level of education.

- The Ministry of Education and Training cooperates with the Ministry of Home Affairs and the Sports Committee:

+ Issue standards for physical education and sports teachers and lecturers;

+ Develop staffing norms for physical education and sports teachers and lecturers for each education level, meeting the orientation and needs for the development of the physical strength and stature of students in schools and other educational institutions within the national education system appropriate to each level of education.

- Agencies managing state matters in education and training, schools, and other educational institutions within the national education system have responsibilities to facilitate the activities of students' physical education and sports clubs and affiliated physical education centers.

- Schools and other educational institutions ensure the proper investment, construction, and use of facilities dedicated to physical education courses and sports activities as per the Law on Education, Law on Physical Education and Sports, and related laws.

Thus, the State has 5 responsibilities regarding physical education and sports in schools as outlined above.

Based on the provisions of Article 24 of the Law on Physical Training and Sports 2006 regarding the rights and obligations of students:

Rights and obligations of students

1. Fulfill the academic tasks in the physical education subject.

2. Participate in sports activities according to their interests.

3. Be selected into sports gifted schools.

4. Utilize facilities, equipment, and means for physical education and sports in schools.

Thus, participating in physical education and sports in schools is a right and an obligation of students when participating in the general educational environment of the school.

What are regulations on the physical education curriculum in lower secondary schools?

According to clause 1, Article 3 of the Decree 11/2015/ND-CP:

Physical Education subject curriculum

1. The Physical Education subject curriculum is part of the general education, vocational education, and higher education programs; the physical education content is part of the preschool education program, reflects the objectives of physical education; prescribes standards of knowledge, skills, scope and structure of physical education content, methods, and forms of organizing physical education activities, ways of evaluating the results of implementing the Physical Education subject at each educational level or training degree.

According to the regulation above, the Physical Education subject curriculum is part of the general education program.

This Physical Education subject curriculum includes physical education content part of the preschool education program, reflects the objectives of physical education; prescribes standards of knowledge, skills, scope and structure of physical education content, methods, and forms of organizing physical education activities, and ways of evaluating the results of implementing the Physical Education subject at the lower secondary education level.
