1. The Director of the Department of Education and Training of a local jurisdiction where a school for the gifted is based shall be accorded authority to license educational operations of the school for the gifted.

2. Documentation requirements and processes for grant of a license for educational operations of a school for the gifted shall be similar to those applied to a secondary school as provided in Article 28 hereof.

Thus, the Director of the Department of Education and Training of a local jurisdiction where a school for the gifted is based shall be accorded authority to license educational operations of an upper secondary school for the gifted in Vietnam.

What are the licensing requirements for educational operations of an upper secondary school for the gifted in Vietnam?

Under Article 57 of Decree 46/2017/ND-CP, the licensing requirements for educational operations of an upper secondary school for the gifted in Vietnam are as follows:

The school must meet licensing requirements for educational operations of an upper secondary school as prescribed by Article 27 hereof and the following requirements:

1. The school’s curriculum and syllabus must be provided in accordance with applicable laws and regulations on schools for the gifted.

2. The school must hire a staff of administrative officers, teachers and employees that are adequate, meet qualification, competency and conduct standards to be able to complete missions of a school for the gifted.

Thus, the licensing requirements for educational operations of an upper secondary school for the gifted in Vietnam are as follows:

(1) Meeting the operational conditions for high schools, specifically:

- Having a decision to establish or approve the establishment by the competent authority as stipulated in Clause 1, Article 26 of Decree 46/2017/ND-CP.

- Owning land, school head office, facilities and equipment that meet regulatory requirements concerning educational operations.

School facilities shall conform to the following requirements:

+ The classroom must be built in conformity with the stipulated specifications, be furnished with an adequate number of chairs and desks of which the height fits for all students, teacher's chairs and desks, boards, and ensure good illumination, cool air and be capable of operating in two shifts a day;

+ The specialist classroom must be subject to regulations on the specialist classroom, adopted by the Minister of Education and Training;

+ Block of facilities providing educational support services, e.g. multifunctional physical activity facility, library, Young Pioneer – Youth Union activity facility and historical exhibition house;

+ Block of clerical and administrative facilities, e.g. rector’s offices, vice rector’s offices, meeting halls that can receive all of the administrative officers, teachers and employees, rooms intended for subject groups, healthcare service rooms, storage facilities, guest contact and reception rooms and Communist Party or Union activity rooms;

+ Playgrounds and physical training courtyards that occupy at least 25% of total usable area of the school and are fully furnished with equipment used for physical and sport activities as well as ensure safety for use;

+ Parking lots that must be arranged at suitable areas within the precinct of the school, ensure conformity to safety, security and sanitation standards;

+ Information technology facilities and systems with internet connection that match teaching and learning demands.

- The school must be located at an area that helps provide a good and safe educational environment for students, teachers, administrative officers and employees. The school must be located at a separate area with perimeter walls, school main entrance gate and school name sign.

- Having an educational program and teaching, learning materials suitable for each educational level.

- Having a team of qualified and well-trained teachers and managers meeting the standards for each educational level; sufficient in number according to the structure of each type of teacher, ensuring the implementation of the educational program and organization of educational activities.

- Having sufficient financial resources as prescribed to ensure the maintenance and development of educational activities.

- Having an organizational and operational regulation of the school.

(2) Having curriculum and syllabus in accordance with applicable laws and regulations on schools for the gifted.

(3) Hiring a staff of administrative officers, teachers and employees that are adequate, meet qualification, competency and conduct standards to be able to complete missions of a school for the gifted.

What are the procedures for the educational operations of an upper secondary school for the gifted in Vietnam?

According to Article 58 of Decree 46/2017/ND-CP, the procedures are stipulated as follows:

1. The Director of the Department of Education and Training of a local jurisdiction where a school for the gifted is based shall be accorded authority to license educational operations of the school for the gifted.

2. Documentation requirements and processes for grant of a license for educational operations of a school for the gifted shall be similar to those applied to a secondary school as provided in Article 28 hereof.

Thus, the procedures for the educational operations of a school for the gifted in Vietnam are as follows:

Step 1: Submission of application

The public school for the gifted, representative of the organization or individual for non-public school for the gifteds send directly or via postal services 01 application to the Director of the Department of Education and Training where the school for the gifted is headquartered.

The application includes:

- The request form for the license to carry out educational operations;

- A copy issued from the original register, a certified true copy, or a copy accompanied by the original for comparison with the decision on establishment or the decision allowing the establishment of the school;

Step 2: Receipt of application

The Director of the Department of Education and Training where the school for the gifted is headquartered receives the application.

If the application is unsatisfactory, a written notification of the contents to be amended and supplemented shall be made to the school within 05 working days from the date of receipt of the application;

Step 3: Appraisal and decision on issuance of a license to carry out educational operations

Within 20 working days from the date of receipt of a complete and valid application, the Director of the Department of Education and Training where the school for the gifted is headquartered shall organize the appraisal of the application and the actual appraisal of the educational operation conditions of the school;

If conditions are met, a license to carry out educational operations will be issued.

If the conditions are not met, a written notice specifying the reasons and solutions shall be sent to the school.
