According to Article 14 of Circular 20/2023/TT-BGDDT:

Administrative job positions

1. Based on legal regulations; the number of students, the nature, the workload, and actual conditions, lower secondary schools determine the number of contractual employees for each administrative job position.

2. Employment contracts are entered into in accordance with current legal regulations.

Thus, according to the above regulations, a lower secondary school in Vietnam shall determine the number of security personnel based on its nature, workload, and actual conditions to submit to competent authorities for approval and implementation.

What are the personnel norms in a lower secondary school in Vietnam?

According to Article 10 of Circular 20/2023/TT-BGDDT stipulating the Framework List of Job Positions in a lower secondary school:

List of job positions, guidelines for job position descriptions in lower secondary schools, ethnic ninority boarding schools, ethnic semi-boarding secondary schools, and schools for people with disabilities (hereinafter collectively referred to as lower secondary schools)

1. The list of leading, managerial, and specialized job titles in lower secondary schools is stipulated in Appendix I attached to this Circular.

2. The list of general and administrative job positions in lower secondary schools is stipulated in Appendix II attached to this Circular.

3. Guidelines for job position descriptions:

a) The description of leading, managerial job positions in a lower secondary school is guided in Appendix III attached to this Circular;

b) The description of specialized job titles in a lower secondary school is guided in Appendix V attached to this Circular;

c) The description of general and administrative job positions in a lower secondary school shall follow the guidelines in Circular No. 12/2022/TT-BNV.

4. Based on the guidelines for describing leading, managerial job positions, specialized job positions, general and administrative job positions stipulated in Clause 3 of this Article, lower secondary schools develop specific and appropriate job position descriptions for each job position of the unit, submit for approval to competent authorities in accordance with regulations.

General Job Positions

What are the principles for determining job positions and personnel norms by a lower secondary school in Vietnam?

According to Article 2 of Circular 20/2023/TT-BGDDT stipulating principles for determining job positions and personnel norms as follows:

- The determination of job positions and personnel norms in public general education institutions shall follow the provisions of Article 3 of Decree 106/2020/ND-CP.

- Job positions and personnel norms in public general education institutions must ensure:

+ Sufficient personnel according to the norms specified in this Circular to carry out the teaching of all subjects and educational activities in the general education program issued by the Ministry of Education and Training and to perform general and administrative jobs of the public general education institution;

+ Job positions that do not have enough workload to perform according to the prescribed time of one employee shall be assigned concurrent tasks.

Those job positions that have not yet been assigned staff will hire contractual employees or assign concurrent tasks.

Those assigned concurrent tasks must be trained and fostered to meet the professional capacity and expertise of the concurrent job positions.

- The number of teachers in public general education institutions includes teachers recruited into public employees and teachers under employment contracts.

Public general education institutions that have a lower number of teachers being public employees than the maximum norm specified in Circular 20/2023/TT-BGDDT (due to insufficient personnel or not being able to recruit) shall determine the number of contracted teacher positions according to the maximum norm specified in Circular 20/2023/TT-BGDDT and contract teachers in accordance with Decree 111/2022/ND-CP.

- Personnel norms and job positions stipulated in this Circular are determined based on the class scale of each public general education institution.

- For schools with multiple educational levels:

+ The number of vice principals shall follow the regulation on the number of deputies in Decree 120/2020/ND-CP;

+ The number of teachers shall follow the regulations in Circular 20/2023/TT-BGDDT for each educational level;

+ The list of job positions, the number of positions of specialized professional job titles (excluding teachers, teachers in charge of the Ho Chi Minh Young Pioneer Organization, and support for educating people with disabilities), general job positions, and administrative job positions in schools with multiple educational levels shall follow the regulations for the highest educational level.

The number of classes or number of students as the basis for calculating the number of job positions according to the regulations for the highest educational level is the total number of classes or total number of students of all educational levels;

+ Support job positions for educating people with disabilities in schools with multiple educational levels with disability-inclusion students: Schools with fewer than 20 disability-inclusion students are arranged 01 person; schools with 20 or more disability-inclusion students are arranged a maximum of 02 people;

+ Each school may arrange 01 teacher (elementary or lower secondary school teacher) to act as the chief of the Ho Chi Minh Young Pioneer Organization.
