* Procedures for establishing a people-found university:
According to the regulations from Articles 6 to 10 of the Regulation on People-found Universities issued together with Decision 86/2000/QD-TTg, the procedures for establishing a people-found university are as follows:
Step 1: When ensuring the conditions stipulated in Article 5 of the Regulation on People-found Universities issued together with Decision 86/2000/QD-TTg, the organization applying to establish the university submits the application to the Ministry of Education and Training. The application includes:
- A proposal for establishing the university, clearly stating:
+ The name of the university;
+ The operating principles and purposes of the university;
+ The address of the university's headquarters;
+ Proposed training disciplines and operational scope;
+ Proposed enrollment scale.
- The establishment scheme of the university as prescribed in Article 5 of this Regulation.
- Draft Regulation of the university's organization and operation.
- Documents from competent authorities certifying the initial technical facilities in line with the proposed enrollment scale according to the corresponding minimum norms currently applied to public universities and the investment capacity to develop the university.
- Land use application, or an agreement by competent authorities on land use rights to build the university.
- A proposed list of the Managing Board, the President, and the university's organizational structure; the resumes of the members of the Managing Board and the university's management staff, confirmed by the direct personnel management agency.
- A list of regular lecturers and scientists, alongside a commitment to participate in teaching at the university.
- A commitment to establish the university premises corresponding to the proposed training scale and disciplines within 10 years.
Step 2: The Ministry of Education and Training receives the application and presides over and collaborates with the Ministry of Planning and Investment, the Ministry of Finance, the Organization and Personnel Department of the Government of Vietnam, the People's Committee of the province where the university is headquartered, and relevant agencies to appraise and submit to the Prime Minister of the Government of Vietnam for consideration and decision.
Step 3: After the Prime Minister of the Government of Vietnam decides to establish the university, the Minister of Education and Training considers the proposal of the organization applying to establish the university to:
- Decide to recognize the Managing Board and the Chairman of the Managing Board.
- Decide to recognize the President.
- Approve the Regulation of the university's organization and operation.
- Approve the training programs, disciplines, and enrollment scale in line with the university's conditions.
- Issue a decision to allow enrollment.
* After 01 year from the date the Prime Minister of the Government of Vietnam decides to establish the university, the Minister of Education and Training shall submit to the Prime Minister of the Government of Vietnam to revoke the decision to establish the university if the university fails to meet the requirements stipulated in Clauses 1, 2, 3, 4, Article 8 of the Regulation on People-found Universities issued together with Decision 86/2000/QD-TTg.
The organization applying to establish the university through its representative in the Managing Board continues together with the Managing Board and the President to be responsible for the university's entire activities.
In case the university operates not according to the set principles and purposes, the organization applying to establish the university has the right to request state management agencies to review and handle it according to the law.
What is the organizational structure of a people-found university?
Under Article 11 of the Regulation on People-found Universities issued together with Decision 86/2000/QD-TTg, the organizational structure of a people-found university includes:
- The Managing Board.
- The President.
The Principal is assisted by:
+ Vice-Presidents;
+ Functional Departments and Divisions;
+ The Scientific and Training Council.
- Some training organizations: faculties, departments, subjects.
- Some organizations serving scientific research and development and established and operated according to legal regulations.
- The CPV organization and mass organizations.
What are the funding sources of a people-found university in Vietnam?
Under Article 37 of the Regulation on People-found Universities issued together with Decision 86/2000/QD-TTg, the funding sources of a people-found university include:
(1) Internal revenue sources:
- Tuition fees from students.
- Fees from students.
- Value of training, scientific research, and production labor contracts.
- Interest from bank deposits.
- Revenue from the liquidation of assets belonging to the university's capital.
Service provision activities (if any).
(2) Contributions from organizations and individuals (collectively called investors) for the investment and development of the university.
(3) Sponsorships, aids, support, and gifts from organizations and individuals within and outside the country.
(4) Loan capital from credit institutions and banks.
(5) Other revenues.
