What is the plan for streamlining the apparatus of Ministries and Ministry-level agencies in Vietnam according to Plan 141?

Under sub-section 2.2 of Section II of the Plan 141/KH-BCDTKNQ18 of 2024, the orientation plan for reorganizing and streamlining the apparatus of Ministries and Ministry-level agencies under the Government of Vietnam is outlined as follows:

(I) Maintain 08 Ministries and ministerial-level agencies (with internal reorganizing and streamlining)

- For ministries, include: (1) Ministry of National Defense; (2) Ministry of Public Security; (3) Ministry of Justice; (4) Ministry of Industry and Trade; (5) Ministry of Culture, Sports, and Tourism.

- For ministerial-level agencies, include: (1) Office of the Government of Vietnam; (2) Government Inspectorate of Vietnam; (3) State Bank of Vietnam.

The proposal to maintain these ministries and ministerial-level agencies is necessary for ensuring stability, inheritance, and alignment with current practical needs.

(II) Orientation for structuring, organizing, and merging 14 ministries, ministerial-level agencies

- Merging the Ministry of Planning and Investment and the Ministry of Finance. The provisional name after the merger is Ministry of Finance and Development or Ministry of Economic Development (performing state management functions over sectors and areas currently assigned to the Ministry of Finance and the Ministry of Planning and Investment).

- Merging the Ministry of Transport and the Ministry of Construction. The provisional name after the merger is Ministry of Infrastructure Development or Ministry of Transport and Urban, Rural Construction (performing state management functions over sectors and areas currently assigned to the Ministry of Transport and the Ministry of Construction).

- Merging the Ministry of Natural Resources and Environment and the Ministry of Agriculture and Rural Development. The provisional name after the merger is Ministry of Agriculture and Natural Resources, Environment (performing state management functions over sectors and areas currently assigned to the Ministry of Natural Resources and Environment and the Ministry of Agriculture and Rural Development), addressing some overlaps in management tasks regarding water resources, river basins, and biodiversity.

- Merging the Ministry of Information and Communications and the Ministry of Science and Technology. The provisional name after the merger is Ministry of Science, Technology and Digital Transformation or Ministry of Science, Technology, Digital Transformation, and Communications (performing state management functions over sectors and areas currently assigned to the Ministry of Information and Communications and the Ministry of Science and Technology).

- Merging the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Home Affairs into Ministry of Home Affairs and Labor and transferring state management functions concerning vocational education to the Ministry of Education and Training, transferring state management functions concerning social protection, children, prevention, and combat of social evils to the Ministry of Health.

- The Ministry of Health actively cooperates with the Central Organizing Committee in taking over certain tasks of the Central Health Protection and Care Committee (upon its dissolution); meanwhile, it is proposed to take over state management concerning: social protection; children; and prevention, combat of social evils from the Ministry of Labor, War Invalids and Social Affairs.

- The Ministry of Foreign Affairs proactively coordinates to take over main tasks from the Central External Relations Committee, the National Assembly's Foreign Affairs Committee (upon their dissolution).

- The Ministry of Home Affairs proactively develops a plan to reorganize the National Academy of Public Administration by merging it into the Ho Chi Minh National Academy of Politics; simultaneously takes the lead, cooperates with the Ministry of Labor, War Invalids and Social Affairs to develop a proposal to merge the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Home Affairs (after transferring certain functions to the Ministry of Education and Training, the Ministry of Health); cooperates with the Committee for Ethnic Affairs to transfer the functions, tasks of the Government's Committee for Religious Affairs to the Committee for Ethnic Affairs.

- The Committee for Ethnic Affairs proactively cooperates with the Ministry of Home Affairs to develop a plan to take over the Government's Committee for Religious Affairs and cooperates with the Ministry of Labor, War Invalids and Social Affairs to assume the functions, tasks concerning poverty reduction from the Ministry of Labor, War Invalids and Social Affairs.

What are the tasks of the Ministry of Education and Training of Vietnam outlined in Plan 141?

According to sub-section 3.10 of Section V of the Plan 141/KH-BCDTKNQ18 of 2024, the Ministry of Education and Training of Vietnam is assigned to perform the following specific tasks:

- The Ministry of Education and Training is tasked with leading and cooperating with the Ministry of Labor, Invalids, and Social Affairs, and 2 National Parent Universities (Hanoi and Ho Chi Minh City) in developing a Scheme to consolidate organizational structure to carry out functions, tasks, and powers after receiving functions and tasks from Ministry of Labor, Invalids, and Social Affairs and 2 National Parent Universities (together with a draft Decree stipulating functions, tasks, powers, and organizational structure of the Ministry of Education and Training after restructuring).

- Proactively develop a plan to receive, arrange, restructure, and streamline the head offices of vocational education institutions (transferred from the Ministry of Labor, Invalids, and Social Affairs), ensuring the quality and efficiency of operations.

What are the education authorities in Vietnam?

According to Article 105 of the Education Law 2019, the current education authorities in Vietnam are as follows:

- The Government shall exercise the unified state management of education.

- The Ministry of Education and Training is accountable to the Government for the implementation of state management of preschool education, general education, higher education, vocational secondary education in pedagogy, pedagogical colleges and continuing education.

- The Ministry of Labour – War Invalids and Social Affairs is accountable to the Government for the implementation of state management of vocational education, except for pedagogical vocational secondary education and colleges.

- Within the scope of their duties and authorities, other ministries and ministerial-level agencies shall be responsible for cooperating with the Ministry of Education and Training, Ministry of Labour – War Invalids and Social Affairs to exercise the state management of education.

- The People's Committees of all levels shall implement state management of education according to the Government's delegation and, within the scope of their duties and authorities, shall perform the following duties:

+ Reviewing the education regulatory compliance of local educational institutions;

+ Ensuring conditions concerning teachers, finance, infrastructure, libraries and teaching equipment of public institutions under their management;

+ Developing school types, conducting private sector involvement in education; meeting the demands of scale expansion, improvement of education quality and efficiency in their localities;

+ Implementing State guidelines, policies and local policies to ensure autonomy and accountability for the fulfilment of duties and education quality of educational institutions under their management;

+ Be responsible for the results of the implementation of strategies, plans and policies on educational development at localities.
