In Vietnam, what day of the week does November 9 fall on?
Few people know that November 9 each year is the Legal Day of the Socialist Republic of Vietnam. On this day in 1946, the first Constitution of the Democratic Republic of Vietnam was enacted. To commemorate this historical event and honor the law, November 9 each year is chosen as the Legal Day of the Socialist Republic of Vietnam.
Under Article 8 of the Law on Law Dissemination and Education 2012 as follows:
Legal Day of the Socialist Republic of Vietnam
November 9 annually is designated as Legal Day of the Socialist Republic of Vietnam. Legal Day of the Socialist Republic of Vietnam is organized to honor the Constitution, law, and educate the sense of respect for the rule of law to everyone in society.
The Government of Vietnam prescribes detailed regulations on this Article.

Which authority is responsible for urging the organization of the Legal Day of the Socialist Republic of Vietnam?
According to Article 2 of Decree 28/2013/ND-CP:
Responsibilities of the Ministry of Justice
The Ministry of Justice takes responsibility before the Government for performing the tasks prescribed in Clause 1 Article 6 and Clause 1 Article 25 of the Law on legal popularization and education, and has responsibility for executing the following tasks:
1. To promulgate provisions on professional operations, standards and professional rules involving legal popularization and education.
2. To urge and examine other ministries, ministerial-level agencies, government- attached agencies and People’s Committees at all levels in urging the organization of the Legal Day of the Socialist Republic of Vietnam.
3. To coordinate with other ministries, sectors, localities and relevant organizations in implementing the policy on socialization of legal popularization and education activities.
4. To promulgate a set of criteria for assessing the efficiency of legal popularization and education activities.
5. To sum up, make statistics of and report on legal popularization and education activities nationwide to the Government.
6. To conduct preliminary and final reviews, and commend collectives and individuals that record outstanding achievements in urging the organization of and performing the Legal Day of the Socialist Republic of Vietnam and socializing legal popularization and education activities.
Thus, under the above regulations, the Ministry of Justice is responsible for urging the organization of the Legal Day of the Socialist Republic of Vietnam.
What are the regulations on the system of legislative documents in Vietnam?
Legislative documents are documents that contain legal regulations and the promulgation of which complies with regulations of law on authority, manner, and procedures provided for in the Law on Promulgation of Legal Documents 2015.
Legislative documents that contain legal regulations but the promulgation of which complies with regulations of law on authority, manner, and procedures provided for in the Law on Promulgation of Legal Documents 2015 are not considered legislative documents.
According to Article 4 of the Law on Promulgation of Legal Documents 2015 and Article 1 of the Revised Law on Promulgation of Legal Documents 2020, the system of legislative documents includes:
1. The Constitution.
2. Codes and Laws (hereinafter referred to as Laws), Resolutions of the National Assembly
3. Ordinances, Resolutions of the Standing Committee of the National Assembly; Joint Resolutions between the Standing Committee of the National Assembly and the Management Board of Central Committee of Vietnamese Fatherland Front; Joint Resolutions between the Standing Committee of the National Assembly, the Government, the Management Board of Central Committee of Vietnamese Fatherland Front.
4. Orders, Decisions of the President.
5. Decrees of the Government; Joint Resolutions between the Government and Management Board of Central Committee of Vietnamese Fatherland Front
6. Decision of the Prime Minister.
7. Resolutions of Judge Council of the People’s Supreme Court.
8. Circulars of the Executive Judge of the People’s Supreme Court; Circulars of the Chief Procurator of the Supreme People’s Procuracy; Circulars of Ministers, Heads of ministerial agencies; Decisions of the State Auditor General.
8a. Joint Circulars between the Executive Judge of the People’s Supreme Court, the Chief Procurator of the Supreme People’s Procuracy, the State Auditor General, Ministers, Heads of ministerial agencies. Joint Circulars between Ministers and Heads of ministerial agencies shall not be promulgated.
9. Resolutions of the People’s Councils of central-affiliated cities and provinces (hereinafter referred to as provinces).
10. Decisions of the People’s Committees of provinces.
11. Legislative documents of local governments in administrative - economic units.
12. Resolutions of the People’s Councils of districts, towns and cities within provinces (hereinafter referred to as districts).
13. Decisions of the People’s Committees of districts.
14. Resolutions of the People’s Councils of communes, wards and towns within districts (hereinafter referred to as communes).
15. Decisions of the People’s Committees of communes.
The rules for formulating and promulgating legislative documents in Vietnam are stipulated in Article 5 of the Law on Promulgation of Legal Documents 2015. To be specific:
- Ensure the constitutionality, legitimacy, and uniformity of legislative documents in the legal system.
- Comply with regulations of law on authority, manner, and procedures for formulating and promulgating legislative documents.
- Ensure transparency of legislative documents.
- Ensure the feasibility, frugality, effectiveness, promptness, accessibility, and practicality of legislative documents; integrate gender equality issues in legislative documents; ensure simplification of administrative procedures.
- Ensure national defense and security, environmental protection without obstruction of implementation of the international agreements to which the Socialist Republic of Vietnam is a signatory.
- Ensure publicity and democracy in receipt of and response to opinions, complaints of agencies, organizations, and individuals during the process of formulating and promulgating legislative documents.
