What are the measures for supporting students who are at risk of school violence in Vietnam?

Under Article 6 of Decree 80/2017/ND-CP, three measures for supporting students who are at risk of school violence in Vietnam are stipulated as follows:

- Timely detect any student who uses aggressive behavior and may cause school violence, as well as any student who is at risk of such violence.

- Analyze the level of risk and predict the violent behaviors that may occur in order to develop specific prevention and support measures.

- Counsel the student who is at risk of school violence and who may cause such violence in order to prevent and eliminate the risks of such behaviors.

What are the actions against school violence occurring in​ vocational education and training institutions in Vietnam?

According to Article 9 of Circular 38/2019/TT-BLDTBXH, actions against school violence occurring in​ vocational education and training institutions in Vietnam are specified as follows:

- Implement measures to promptly isolate and control the individuals causing school violence, preventing them from continuing to cause further unwanted consequences.

- Immediately contact and report the incident to the competent authorities for resolution according to regulations. If the incident exceeds the capability of the vocational education and training institution, promptly notify the local government or functional agencies to coordinate handling according to legal regulations.

- Conduct a preliminary assessment of the victim's damage level. Immediately provide necessary assistance and medical care to the victim; monitor, evaluate and implement practical support measures to ensure the victim's safety in the future.

- Promptly inform the victim’s family for coordinated handling.

What are the regulations on prevention of school violence in vocational education and training institutions in Vietnam?

Pursuant to Article 7 of Circular 38/2019/TT-BLDTBXH, the prevention of school violence in vocational education and training institutions in Vietnam is specified as follows:

- Educate and equip students, management staff, teachers, school employees, and students' families with knowledge and skills to prevent and combat abuse, school violence, and violence in the online environment; provide education and counseling on self-protection knowledge and skills for students.

- Regularly monitor, record, and analyze groups at risk of school violence; develop cooperation mechanisms with competent agencies and procedures for handling school violence situations.

- Establish communication channels between vocational education and training institutions, students' families, and relevant organizations and individuals to promptly prevent and address school violence situations.

Will students engaging in school violence be subject to expulsion from school?

Subsection 4, subsection 5 of Section III from Circular 08/TT of 1988 stipulates expulsion for one week or one year for students' violations as follows:

Expulsion for One Week:

- Students who commit violations that have been warned before the entire school but do not show remorse or improvement, adversely affecting other students;

- Students who commit a first-time violation that is severe in nature and extent, severely affecting the school's and teachers’ honor and the student body, such as: theft, bullying, organized fighting causing injuries to others, ... or committing other offences of equivalent nature and severity, will have their cases reviewed by the school disciplinary council for a proposal to the Principal for decision and execution while reporting to the direct higher education management agency for knowledge and supervision.

Expulsion for One Year:

- Students who continue to commit offenses despite being expelled for one week by the school disciplinary council through the Principal without showing remorse or continue to commit additional violations.

- Students who commit very serious offenses, though it is the first time, but the action is intentional and premeditated (not induced or accomplice), causing significant and dangerous harm to social property and human lives, such as: participating in organized theft, bullying, decadence, reactionary activities, … using weapons (such as daggers, bayonets, revolvers, grenades, …) in organized fights causing injuries, involvement in legal offences outside school resulting in police arrest or committing other offenses of similar nature and severity.

Thus, students exhibiting school violence may be considered for expulsion from shool depending on the severity of the offense.
