- Public holidays as regulated by the Labor Law, if they fall on weekends, will be substituted for the next working day. School principals are to proactively develop appropriate educational plans for their units in compliance with the regulations.

What are the latest rights of primary, lower secondary, and upper secondary students in Vietnam?

The rights of primary, lower secondary, and upper secondary students are as follows:

(1) Rights of primary students

According to Article 35 of the Primary School Regulations issued together with Circular 28/2020/TT-BGDDT, primary students shall have the following rights:

- Right to education

+ To be educated, to study to develop comprehensively, and to bring forth the best potential of themselves; to study in a school or class implementing the primary education program convenient for commute in their residential area.

+ Students may choose their school or transfer to another school outside their residential area, if the school has the capacity to accept them.

+ Students of primary school age returning from abroad, children of foreign nationals studying and working in Vietnam, children unable to attend school due to difficult circumstances who wish to attend a primary school will have their level evaluated for appropriate class placement.

+ Disabled students are entitled to inclusive education in a primary school; their conditions for study and training are ensured; they are assessed based on their individual education plans.

+ Students may shorten the duration of the program, study at a higher age, extend the duration, or repeat a grade.

+ Students with good physical health and early intellectual development may skip grades within the educational stage. The procedure for consideration in specific cases follows these steps:

++ Parents or guardians of the student submit a written request to the school.

++ The school principal establishes a survey and advisory council, including the principal or vice-principal, the parents' representation board, the student’s current and intended grade teachers, a healthcare worker, and the Team leader.

++ Based on the results of the advisory council, the principal completes the documentation and reports to the Head of the Education and Training Department for consideration and decision.

+ Students with limited academic progress, despite having direct assistance from teachers, parents, or guardians, may be promoted or retained based on the level of unmet educational and training tasks. Teachers report to the principal for review and decision, and in coordination with the family, decide on appropriate educational measures.

- To be protected, cared for, respected, and treated equally and democratically; to be ensured legitimate rights and interests; to be provided complete information regarding their academic and training process; to be ensured conditions of time, facilities, hygiene, and safety for study and training.

- To participate in activities to express their individual abilities; to express their personal opinions and aspirations.

- To receive scholarships and social benefits according to regulations.

- To enjoy other rights as stipulated by law.

(2) Rights of Lower Secondary and Upper Secondary students

The rights of Lower Secondary and Upper Secondary students are specified in Article 35 of the Regulations for Lower Secondary, Upper Secondary Schools, and multi-level Schools issued together with Circular 32/2020/TT-BGDDT:

- To enjoy equality in comprehensive education, to be ensured conditions of time, facilities, hygiene, and safety for study in class and self-study at home, to be informed about their learning and training status, to use school facilities and means serving academic, cultural, and sports activities according to regulations.

- To be respected and protected, to be treated equally and democratically, to have the right to appeal to the school and educational management authorities for decisions concerning them; to transfer schools for valid reasons according to current regulations; to study ahead of age, skip grades, or study at a higher age as specified in Article 33 of the Regulations for Lower Secondary, Upper Secondary Schools, and multi-level Schools issued together with Circular 32/2020/TT-BGDDT.

- To participate in activities to develop talents in subjects, sports, and arts organized by the school if they meet the qualifying conditions.

- To receive scholarships or other forms of support under the regulations for socially disadvantaged students, those with life difficulties, and students with exceptional abilities.

- To transfer schools if meeting the conditions as stipulated; the transfer procedure follows the regulations of the Minister of Education and Training.

- To enjoy other rights as prescribed by law.
