The Ho Chi Minh City Department of Education and Training has just announced the list of 50 outstanding female officials in the education sector for the year 2024.

On October 22, 2024, the Department of Education and Training of Ho Chi Minh City issued Announcement 56/TB-CDGD 2024 (download) regarding the announcement of the selection results of 50 outstanding female officials for 2024.

The recognition ceremony will be held on October 30, 2024.

What are conditions for maternity leave policies for female teachers in Vietnam?

According to the provisions of Article 31 Social Insurance Law 2014:

Conditions for enjoying maternity leave policies

  1. Employees are entitled to maternity leave policies when falling into one of the following cases:

a) Female employees who are pregnant;

b) Female employees who give birth;

c) Female employees who are surrogate mothers and the mothers who hire the surrogates;

d) Employees who adopt a child under 06 months old;

dd) Female employees who use contraception implants or employees who undergo sterilization;

e) Male employees who are paying social insurance and have a wife giving birth.

  1. Employees specified in points b, c, and d of clause 1 of this Article must pay social insurance for at least 06 months within 12 months before giving birth or adopting a child.
  1. Employees specified in point b of clause 1 of this Article who have paid social insurance for at least 12 months but must take leave from work to take care of pregnancy under the prescription of accredited medical institutions must continue paying social insurance for at least 03 months within 12 months before giving birth.
  1. Employees who qualify under clauses 2 and 3 of this Article and terminate their labor contracts, employment contracts or leave work before giving birth or adopting a child under 06 months old still are entitled to maternity leave policies as stipulated in Articles 34, 36, 38, and clause 1 Article 39 of this Law.

Female teachers are entitled to maternity leave policies if the conditions are as follows:

- Teachers must pay social insurance for at least 06 months within 12 months before giving birth (clause 2 Article 31 Social Insurance Law 2014). If taking pregnancy leave upon the request of accredited medical facilities, they must pay insurance for at least 03 months within 12 months before giving birth.

- In cases where the female teachers do not pay enough social insurance for 06 months within 12 months before giving birth or before adopting a child, they will be entitled to policies regarding prenatal check-ups, miscarriage, abortion, stillbirth, pathological abortion, or mother’s death after childbirth based on the provisions at point a clause 1 Article 39 Social Insurance Law 2014.

What is the maximum maternity leave duration for female teachers giving birth to twins in Vietnam?

According to Article 34 Social Insurance Law 2014, the duration of policies when giving birth is as follows:

  1. Female employees who give birth are entitled to leave for maternity leave policies for 06 months. In the case of giving birth to twins or more, from the second child onward, each child grants the mother an additional 01 month of leave.

The maximum duration of maternity leave before childbirth is not more than 02 months.

  1. Male employees who are paying social insurance when their wife gives birth are entitled to maternity leave policies as follows:

a) 05 working days;

b) 07 working days if the wife undergoes surgery or gives birth to a baby less than 32 weeks old;

c) In case of twins, he is entitled to 10 working days, and for triplets or more, an additional 03 working days for each additional child;

d) In case of twins or more giving birth requiring surgery, the leave is extended to 14 working days.

The leave for maternity leave policies stipulated in this clause is calculated within the first 30 days from the day of the wife's childbirth.

  1. In case after childbirth, if a child under 02 months old dies, the mother is entitled to 04 months of leave from the date of childbirth; if a child over 02 months old dies, the mother is entitled to 02 months of leave from the date of the child's death, but the leave duration does not exceed the time regulated in clause 1 of this Article; this time is not counted in personal leave time as regulated by labor law.

Therefore, in the case of giving birth to twins, female teachers are entitled to a maximum of 07 months of maternity leave.
